    Neutral Citation No. - 2023:AHC-LKO:67900

    Court No. - 8

    Case :- WRIT - C No. - 9059 of 2023

Petitioner :- Smt. Kalawati Respondent :- State Of U.P. Thru. Addl. Chief Secy. Deptt. Of Food And Civil Supplies, Lko. And 3 Others Counsel for Petitioner :- Ram Lakhan Vishwakarma,Ranjeet Pratap Singh,Vinay Pratap Singh Rathore Counsel for Respondent :- C.S.C.

    Hon'ble Pankaj Bhatia,J.

    1. Present petition has been filed by the petitioner challenging the order dated 27.07.2023 whereby the appeal preferred by the petitioner was dismissed.

    2. Admittedly, the petitioner was a subsequent allottee and in terms of the provisions of the Government Order dated 05.08.2019, particularly Clause 8(3), wherein it was specifically provided that in the event, the appeal of the original allottee is decided, any subsequent challenge by the subsequent allottee would not be maintainable, the appeal was dismissed as not maintainable.

    3. Even otherwise, the allotment of the petitioner was a contingent allotment and not a regular allotment, as such, I do not see any reason to interfere with the order dated 27.07.2023.

    4. The petition lacks merit and is accordingly dismissed.
