The Learned Counsels are appearing for the Respondents. The Learned Counsel for the State of Rajasthan has submitted a synopsis. However, the State is directed to file a specific affidavit along with the survey sheet indicating the extent of the Sariska Tiger Reserve and also in the said survey sheet/map indicate the core area and the buffer zone as well as the outer boundary of the National Park and Tiger Reserve as notified.
In case the State Government of Rajasthan has submitted any proposal to the MoEF, Govt of India for declaration of eco-sensitive zone around the National Park (Sariska) the same shall be filed. The concerned affidavit shall also indicate the position with regard to declaration of the eco-sensitive zone and whether such proposal has been approved and necessary notification to that effect is issued. If such proposals have not been approved, the stage at which the same is under consideration by the MoEF, Govt of India may be informed.
In the site plan/map required to be filed the State Government shall also clearly indicate the location and aerial distance of the mine of the Respondent from the core area, buffer area and outer boundary. The said plan shall also indicate other mining leases which may be in operation in the area since it was submitted before kavita us that a large number of mines are under operation in and around the Sariska Reserve. Their aerial distance from the notified boundary shall also be indicated. The said information to be filed within two weeks.
Looking to the entire facts and circumstances and also considering the question of irreparable loss to the environment as alleged by the petitioner, we deem it just and proper to restrain the Respondent No. 5 from carrying out any further mining operations and removal of minerals from the mines in question.
