Smt Sanchita Sarkar v. Smt Susmita Sikdar & anr

    1Sl.

May 15, 2018 High Court at Calcutta Revisional Jurisdiction C.O. 1136 of 2018 Smt. Sanchita Sarkar Versus Smt. Susmita Sikdar & anr.

Mr. Tarak Nath Halder, for the petitioner.

The propounder in a probate proceeding has preferred the instant revisional application under Article 227 of the Constitution of India, seeking expeditious disposal of such proceeding.

It appears that the said proceeding is already on the peremptory hearing board and is pending for quite a long time.

In view of nature of the order proposed to be passed, no prior service of notice of this revisional application on the opposite parties is deemed necessary.

C.O. No. 1136 of 2018 is therefore disposed of by requesting the Additional District Judge, First Fast Track Court at Sealdah, District: South 24-Paraganas, to dispose of Original Suit No. 1 of 2011, pending in the said court as expeditiously as possible, positively within September 30, 2018, without granting any unnecessary adjournment to either of the parties.

There will be no order as to costs.

The petitioner is directed to communicate this order to the court below as well as to the opposite parties or their learned advocate in the court below at the earliest.
