Dipankar Datta, J.:— Copy of the report filed by the Officer-in-Charge, Shaympukur Police Station through Mr. Gupta, learned advocate for the State shall be retained with the records.
Although it has been alleged in paragraph 12 of the writ petition by the petitioner that she was forced to undergo medical termination of pregnancy at the instance of the family of her husband (respondent no. 4, Subhadip Paul), the document annexed to the report filed by the Officer-in-Charge, Shyampukur Police Station prima facie is to the contrary. It appears that the petitioner had given her consent by signing such document to undergo medical termination of pregnancy.
If at all the claim raised in paragraph 12 of the writ petition is to be believed, there is no reason as to why the petitioner did not disclose that she was forced to sign the document.
At this stage Mr. Roy, learned advocate appearing for the petitioner seeks some time to take instructions on the document signed by the petitioner signifying her consent to undergo medical termination of pregnancy.
Mr. Gupta, learned advocate appearing for the State shall hand over a copy of the said document in course of this day to Mr. Roy.
Put up the writ petition under the same heading on Wednesday next (14.05.2014).
