Bengal Bio Environment Welfare Association & Anr. v. The State Of West Bengal & Ors.

Soumitra Pal, J.:— In the writ petition, the petitioner no. 1, a registered NGO and the petitioner no. 2, its secretary, have prayed for a direction upon the authorities of the West Bengal Renewable Energy Development Agency, an organisation of Department of Power and NES, Government of West Bengal, the respondent no. 2 to release the claim amounts of the members of the petitioners who have successfully carried out the work. Prayer has also been made to give further work order to the members of the petitioners.

    2. Heard learned advocates for the parties.

    3. Since it is evident from the writ petition that it is essentially a question of money claim and some of the payments were made in the year 2007-2008, the writ petition is not maintainable.

    4. The judgments relied on by the petitioner in ABL International Ltd. v. Export Credit Guarantee Corporation of India Ltd., (2004) 3 SCC 553 and Godavari Sugar Mills Limited v. State of Maharashtra, (2011) 2 SCC 439 are not applicable as this is not a writ petition involving a consequential relief. Therefore, no order is passed on the writ petition.

    5. The writ petition is disposed of.

    6. However, this order shall not prevent the petitioner from applying before the appropriate forum for redressal of the grievances, if any and if so advised.

    7. There will be no order as to costs.
