M/S Friends Cable Network v. Star India Private Limited .

The petitioner's contention is that the respondent is asking it to take signals from a MSO who happens to be its erstwhile partner and, therefore, it is not willing to take signals. Counsel for respondent however, states that as per the regulations, respondent can give signals from its distributor/agent. We find no difficulty in accepting the submission of the respondent which is in accordance with the regulation and direct the petitioner to approach the distributor viz. Ma Radhey TV Network, c/o Mr. Ashwani Kumar Chopra, Ravi Das Nagar, Jaito Road, Kotkapura, Dist. Faridkot (Punjab) to get the signals for its declared base of 1000 subscribers. An agreement as per the regulations will be entered into between the MSO and the petitioner. Counsel for the respondent has made a submission at the Bar that he will ensure that the said distributor will entertain the petitioner and also that good quality signals are supplied to the petitioner. Let this process be completed within two weeks.

    The petition stands disposed of.
