1. The Applicant filed an RTI application dt.17.10.08 with the CPIO, AIR, Kolkatta. He stated that SD, AIR, Kolkatta has issued promotion order of Staff Car Drivers Grade-II to Grade-I on 29.1.08 and his name does not appear in the promotion list and persons junior to him have been shown in the promotion list. In view of the above, he requested for the following information:
a) Date of the DPC held for the above mentioned promotion
b) What were the names and the designation of the Chairman and the other two members of the DPC held for the above mentioned promotion and the office they belonged to
c) As there are no adverse remarks in his CR (as informed vide letter dt.11.9.08) on what grounds he was awarded unfit/not yet fit by the DPC for the post of Grade-I staff car driver (as has been informed vide letter dt.5.9.08)
d) Other than the CR what are the other records w.r.t the drivers that the DPC considered by virtue of which his juniors in the seniority list got promoted bypassing him. Photocopy of the relevant documents in the printed form to be endorsed
e) Photocopy of the report/recommendation of the DPC in the printed form also be provided. The CPIO replied on 24.10.08 stating that in minutes of the meeting of the DPC for consideration of Staff Car Drivers working in AIR stations/offices in the zone of West Bengal and Sikkim held on 21.1.08, the evaluation/views of the members of the DPC were their own and denied disclosure of the names of the members as well as the copy of the minutes of the meeting as it will not serve public interest. Not satisfied with the reply, the Applicant filed an appeal dt.12.12.08 with the Appellate Authority. The Asst. Station Director on behalf of Deputy Director General (ER) replied on 16.12.08 directing the Applicant to submit the appeal in the proper format. Aggrieved with this reply, the Applicant filed a second appeal dt.22.1.09 before the CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the hearing for April 13, 2009.
3. Mr. Pradip Kumar Mitra, Station Director, AIR Kolkata & CPIO and Mr. Abhaya Kumar Padhi, DDG(ER) represented the Public Authority.

5. After reviewing the information provided, the Commission directs the CPIO to provide the missing information against Points (b), (c) and (d) to the Appellant by 30 April, 2009.
