The appellant has sought information under RTI Act by his letter dated 25.9.2007 addressed to the CGM, State Bank of India, Local Head Office, New Delhi requesting information pertaining to his application submitted under SBI-Exit Option Scheme which was declined by the competent authority. Though in his application he has listed 8 queries, only query no. 7 & 8 are related to RTI application, since the appellant wanted to know why he has not been paid the due amount after his retirement on 27.2.2007. ACPIO acknowledged the letter on 1.6.2007 but he has not given any reply to the appellant to his application. Thus an appeal was filed before the AA on 25.10.2007 to which no reply has been sent by the bank. This has resulted in filing up this appeal before the Commission on 18.2.2008.
2. Comments were called for from the Public Authority vide letter dated 11.3.2008 which was submitted by the CPIO on 29.4.2008. DECISION
3. This case came up for hearing on 2.5.2008, which was attended by appellant in person and the bank was represented by Manager (Law) along with the Chief Manager. I have gone through the application as well as the comments. At the outset I would like to point out the CPIO has not provided any reply within 30 days though he has acknowledged the application on 1.6.2007. The appellant has brought this fact in his first appeal which was dated 25.10.2007, no action has been taken by the Appellate Authority. I therefore direct the CPIO to provide the point-wise reply to the appellant within 15 days and also provide the particulars of the first AA and CPIO should show-cause why penalty cannot be imposed on him u/s 20 (1) of the RTI Act and his explanation should reach during the same period. In case if the appellant files any such appeal the AA is directed to dispose of this appeal within 15 days. Let a copy of this decision be sent to the appellant and CPIO.
