Factual and Procedural Background

The appeal arose from an order of the High Court passed on a writ petition. The Labour Court, in an award that was challenged before the High Court, had ordered the reinstatement of the respondent workman, who had been working as a Security Guard.

The High Court dismissed the writ petition, but affirmed the appellant management's right to hold a disciplinary enquiry after issuing a fresh notice to the respondent workman. In the proceedings before the Supreme Court, the management pleaded that it had lost all confidence in the workman. Because confidence was considered necessary for a Security Guard, notice on the special leave petition was issued limited to the question of compensation to the workman in lieu of reinstatement. The matter was adjourned from time to time to allow the parties to agree on compensation, but they failed to reach a settlement.

Legal Issues Presented

  1. Whether, in lieu of reinstatement, compensation should be awarded to the respondent workman, and if so, what the appropriate quantum should be.

Arguments of the Parties

The opinion does not contain a detailed account of the parties' legal arguments.

Court's Reasoning and Analysis

The Court recorded that the management's plea was that it had lost confidence in the respondent workman, and that confidence is a necessary element for a Security Guard. On that basis, the Court limited consideration in the special leave petition to the question of compensation in lieu of reinstatement.

Since the parties were unable to arrive at an agreed figure despite adjournments, the Court fixed compensation itself. In determining the amount, it took into account: (i) the respondent workman's engagement date (7-7-1982), (ii) that only three years of service were left, and (iii) that he was drawing Rs 3045 per month. Having regard to these factors, the Court assessed that compensation in lieu of reinstatement should be Rs 2,25,000, payable within six weeks.

Holding and Implications

APPEAL DISPOSED OF BY AWARDING COMPENSATION IN LIEU OF REINSTATEMENT in the sum of Rs 2,25,000, to be paid within six weeks.

The direct effect is that the respondent workman is to receive a lump-sum payment instead of being reinstated pursuant to the Labour Court's award. The Court also made no order as to costs. The opinion does not indicate that any new precedent or broader legal principle was laid down beyond resolving compensation in this case.

    Order

    1. Delay condoned.

    2. Leave granted.

    3. This appeal impugns the order of the High Court on a writ petition. The High Court dismissed the writ petition but affirmed the right of the appellant management to hold a disciplinary enquiry after fresh notice to the respondent workman. The Labour Court in its award, which was impugned before the High Court, had ordered reinstatement. The respondent workman had been working as a Security Guard. The plea before us was that the appellant management had lost all confidence in the respondent workman. Since the element of confidence is necessary insofar as a Security Guard is concerned, notice was issued on the special leave petition limited to the question of compensation to the respondent workman in lieu of his reinstatement.

    4. From time to time the matter was adjourned to enable the parties to try and work out what that compensation should be. But they have failed to do so. Having regard to the fact that the respondent workman had been engaged on 7-7-1982, only three years of service were left and he was drawing Rs 3045 per month, we are of the view that the compensation in lieu of reinstatement should be fixed at Rs 2,25,000 (Rupees two lakhs and twenty-five thousand). The amount shall be paid within six weeks.

    5. Order on the appeal accordingly.

    6. No order as to costs.
