ORISSA HOMOEOPATHIC MEDICAL
TEACHING SERVICE (APPOINTMENT OF
LECTURER VALIDATION) ACT, 1995 An act to validate the appointment of Lecturer in Dr. Abhin Chandra Homeopathic
Medical College and Hospital, Bhubaneswar.
Be it enacted by the Legislature of the State of Orissa in the Forty-sixth Year of
the Republic of India as follows :
1 (1) This Act may be called the Orissa Homoeopathic Medical Teaching Service
(Appointment of Lecturer Validation) Act, 1995.
(2) It shall come into force at once.
2. In this Act, unless the context otherwise requires,-
(a) "Lecturer" means the lecturer appointed to the service;
(b) "Recruitment Rules" means the Rules regulating recruitment to the Orissa
Homoeopathic Medical Teaching Service (Method of Recruitment and Conditions of
Service) Rules, 1980 published in the notification of the Government of Orissa in the
Health and Family Welfare Department No. 17488-HVI-Med.VS-2/81/H., dated the 19th
May, 1981, as amended from time to time;
(c) "Service" means the service as specified in the Recruitment Rules; and
(d) "Year" means the Calendar year.
3. (1) Notwithstanding anything contained in the Recruitment Rules, Dr. Bishnu
Charan Sahoo shall be deemed to have been validly and regularly appointed as a
Lecturer in the cadre of Senior Teaching posts as defined in Clause (g) of Rule 2 of the
Recruitment Rules with effect from 11.6.1986 on the ground that such appointment shall
be challenged in any Court of law merely on the ground that such appointment is made
otherwise than in accordance with the procedure laid down in the Recruitment rules.
(2) His inter se seniority in the cadre of Lecturer shall be fixed with effect from
11.6.1986.
