[Bihar Act 10, 2020] The Bihar Prohibition and Excise (Amendment and Validation) Act, 2020
AN
ACT
TO AMEND THE BIHAR PROHIBITION AND EXCISE ACT, 2016
Be it enacted by the Legislature of the State of Bihar in the Seventy first year of the Republic of India as follows:-
1. Short title and extent and commencement.—(1) This Act may be called the Bihar Prohibition and Excise(Amendment and Validation) Act, 2020
(2) It shall extend to whole of the State of Bihar.
(3) It shall deemed to have come into force from the date of commencement of Bihar Prohibition and Excise Act, 2016 i.e. from 02.10.2016
2. Amendment to Section-73 of the Bihar Prohibition and Excise Act, 2016.—The words "Sub-Inspector" under Clause (e) of Section-73 of said Act shall be substituted by
"Assistant Sub-Inspector".
3. Amendment to Section-78 of the Bihar Prohibition and Excise Act, 2016.—The words "Sub-Inspector" under sub section (2) of section-78 of said Act shall be substituted by "Assistant Sub-Inspector".
4. Validation.—Notwithstanding anything contained contrary in any other Act, Ordinances, Rules or decision or judgment, decree or order of any Court of Law, the provisions of this Act shall have overriding effect and all acts done according to the provisions of Bihar Prohibition and Excise Act, 2016 by Assistant Sub- inspectors of Police shall be deemed to be valid.
5. Repeal and Saving.—
(i) Prohibition and Excise (Amendment and Validation) Ordinance, 2020 (Bihar Ordinance No.-04, 2020) is hereby repealed.
(ii) Notwithstanding such repeal, anything done or any action taken in exercise of any power conferred by or under the said ordinance shall be deemed to have been done or taken in exercise of the powers conferred by or under this Act as if this Act were in force on the day on which such thing was done or action taken.
