(1) Nothing in this Act shall apply to
(a) the use of any insecticide by any person for his own household purposes or for kitchen garden or in respect of any land under his cultivation;
(b) any substance specified or included in the Schedule or any preparation containing any one or more such substances, if such substance or preparation is intended for purposes other than preventing, destroying, repelling or mitigating any insects, rodents, fungi, weeds and other forms of plant or animal life not useful to human beings.
(2) The Central Government may, by notification in the Official Gazette and subject to such conditions, if any, as it may specify therein, exempt from all or any of the provisions of this Act or the rules made thereunder, any educational, scientific or research organization engaged in carrying out experiments with insecticides.

CENTRAL GOVERNMENT NOTIFICATIONS UNDER SECTION 27(2) & 28 PROHIBITING SALE AND USE OF CERTAIN INSECTICIDES

Whereas, with a view to reviewing the continued use in India of pesticides that are either banned or restricted for use in other countries, the Government of India had set up an Expert Committee.
Now, therefore, after considering the recommendation of the said Expert Committee, and in consultation with the Registration Committee, set up under the Insecticides Act, 1968, the Central Government, in exercise of the powers conferred on it, under sub-section (2) of Section 27 read with Section 28 of the Insecticides Act, 1968, hereby passes the following order:
(1) The use of DDT in agriculture is hereby withdrawn. In very special circumstances warranting the use of DDT for plant protection work, the State or Central Government may purchase it directly from Messrs. Hindustan Insecticides Limited, to be used under expert Government supervision.
699[(2) The use of Dichloro Diphenyl Trichloroethane (DDT) for the domestic public health programme is hereby restricted up to 10,000 Metric Tonnes per annum, except in case of any major outbreak of epidemic. M/s. Hindustan Insecticides Limited, the sole manufacturer of Dichloro Diphenyl Trichloroethane in the country may manufacture Dichloro Diphenyl Trichloroethane for export to other countries for use in vector control for public health purpose. The export of Dichloro Diphenyl Trichloroethane to Parties and State non-parties shall be strictly in accordance with Paragraph 2(b) of Article 3 of the Stockholm Convention on Persistent Organic Pollutants (POPs).
(2-A) Every State Government shall take such steps under the relevant provisions of the said Act and the rules made thereunder as it considers necessary for the execution of this order in the State.]
(3) The Central Government further orders that the registration certificates issued by the Registration Committee to various registrants under Section 9 of the said Act shall stand modified/cancelled to give effect to this order.
(4) It is also ordered that all the holders of the registration certificates for manufacture and import of DDT should return their registration certificates to the Secretary, Registration Committee, Directorate of Plant Protection, Quarantine and Storage, NH-IV Faridabad (Haryana) by the 15th June, 1989.
(5) However, non-endorsement/correction of the registration certificates will not be taken as permission/approval to operate upon original certificate of registration in contravention of the provisions of this order.
(6) Certificates not submitted by the due date shall be deemed to have been cancelled.

Whereas the Government of India had set up an Expert Committee with a view to reviewing the continued use in India of pesticides that are either banned or restricted for use in other countries.
Now, therefore, after considering the recommendations of the said Expert Committee, and in consultation with the Registration Committee, set up under the Insecticides Act, 1968, the Central Government, in exercise of the powers conferred on it, under sub-section (2) of Section 27 read with Section 28 of the Insecticides Act, 1968, hereby passes the following order:
(1) Chlorobenzilate is hereby banned for use in agriculture. If required it can be imported by Government/Semi-Government Organisations and prepared folbex strips for making it available to be-keepers for controlling mites of honeybees.
(2) Dibrome-Chloropropane (DBCP) is hereby banned and the registration certificates issued by the Registration Committee to various registrants shall stand cancelled.
(3) Toxaphene (Camphechlor) is hereby banned and the registration certificates issued by the Registration Committee to various registrants shall stand cancelled.
(4) The use of Sodium Cyanide shall be restricted for fumigation of cotton bales by Plant Protection Adviser to the Government of India under expert supervision.
(5) Penta-Chloro-Nitro-Benzene (PCNB) is hereby banned and the registration certificates issued by the Registration Committee to various registrants shall stand cancelled.
(6) Captafol shall be used only as seed dresser. Its use as foliar spray is hereby banned.
(7) All the holders of the registration certificates for manufacture and import of these insecticides should return their registration certificates to the Secretary, Registration Committee, Directorate of PP. Q&S, NH-IV Faridabad (Haryana) by 31st July, 1989.

Whereas the Government of India had set up an Expert Committee with a view to investigate as to whether the continued use of certain insecticides in India will involve such risk to human beings or animals as to render it expedient or unnecessary (sic) to take immediate action.
And whereas the Central Government after considering the recommendation of the said Expert Committee and after consultation with the Registration Committee, set up under the Insecticides Act, 1968 (46 of 1968) is satisfied that the use of Pentachlorophenol (PCP) involve health hazards to human beings, animals and damage to the environment.
Now, therefore, in exercise of the powers conferred by sub-section (2) of Section 27 of the Insecticides Act, 1968 (46 of 1968), the Central Government hereby passes the following order, namely:
The use of Pentachlorophenol (PCP) is prohibited in India and the registration certificate issued under the said Act shall stand cancelled.

Ministry of Agriculture (Deptt. of Agriculture and Cooperation),
Order No. S.O. 138(E), dated February 17, 1992
Whereas the Government of India had set up an Expert Committee with a view to investigate as to whether the continued use of certain insecticides in India will involve such risk to human beings or animals as to render it expedient or necessary to take immediate action.
And whereas the Central Government after considering the recommendation of the said Expert Committee, set up under the Insecticides Act, 1968 (46 of 1968) is satisfied that the use of Aldrin, Chlordane and Heptachlor are likely to involve health hazards to human beings and animals.
Now, therefore, in exercise of the powers conferred by sub-section (2) of Section 27 of the Insecticides Act, 1968 (46 of 1968), the Central Government hereby passes the following Orders, namely:
(i) The use of Aldrin is phased out in India and the registration certificate issued under the said Act shall stand cancelled with effect from the 31st December, 1993;
(ii) the use of Chlordane is prohibited in India and the registration certificate issued under the said Act shall stand cancelled with immediate effect;
(iii) the use of Heptachlor is prohibited in India and the registration certificate stand cancelled with immediate effect.
(5)
Ministry of Agriculture (Deptt. of Agriculture and Cooperation),
Order No. S.O. 325(E), dated May 11, 1992
Whereas the Central Government had set up an Expert Committee with a view to investigate as to whether the continued use of certain insecticides in India will involve such risk to human beings or animals as to render it expedient or necessary to take immediate action;
And whereas the Central Government, after considering the recommendation of the said Expert Committee and after consultation with Registration Committee set up under the Insecticides Act, 1968 (46 of 1968), is satisfied that the use of Tetradifon, Nicotine Sulphate and Nitrofen involves health hazards to human beings, animals and damage to the environment;
Now, therefore, in exercise of the powers conferred by sub-section (2) of Section 27 of the Insecticides Act, 1968 (46 of 1968), the Central Government hereby passes the following orders with immediate effect, namely:
(i) the use of Tetradifon is prohibited in India and the certificate of registration issued under the said Act shall stand cancelled;
(ii) the use of Nicotine Sulphate is prohibited in India; provided that the Nicotine Sulphate may be continued to be produced in the country only for export purposes and subject to the modification to this effect;
(iii) the use of Nitrofen is prohibited in India and certificate of registration issued under the said Act shall stand cancelled.
(6)
Ministry of Agriculture (Deptt. of Agriculture and Cooperation),
Noti. No. S.O. 648(E), dated September 20, 1996
Whereas the Government of India had set up an Expert Committee, under the Insecticides Act, 1968 (46 of 1968), with a view to investigate the continued use of certain insecticides i.e. Aldrin, Heptachlor and Chlordane in India, which were banned in other countries because of involved risks to human beings and animals, as to render it expedient or necessary to take immediate action;
And whereas the Central Government duly considered the recommendations made by the said Committee and was satisfied that the continued use of Aldrin, Chlordane and Heptachlor is likely to involve health hazards to human beings and animals;
And whereas in exercise of the powers conferred by sub-section (2) of Section 27 of the Insecticides Act, 1968, a notification was issued by the Government of India under the Ministry of Agriculture (Department of Agriculture and Cooperation) vide number S.O. 138(E), dated 17-2-1992, banning the Aldrin with effect from 1-1-1994 and banning the use of both Chlordane and Heptachlor with effect from 17-2-1992;
And whereas M/s Pesticides India Limited filed a writ petition challenging the said notification in the High Court of Rajasthan and the said High Court gave judgment on 17-3-1993 that the said notification was issued without following the principles of natural justice the said notification with a direction to reconsider the matter as regards total ban on sale, production, formulation or import of Heptachlor and Chlordane in India after affording an opportunity of hearing to the petitioners and other registration holders of these two insecticides;
And whereas the Registration Committee constituted under Section 5 of the Insecticides Act, 1968, in order to give due compliance to the order of the Honourable High Court, gave adequate opportunity to the said petitioners and other registration holders and also after convening several meetings with the industry, registration holders and deliberations in an inter-Ministerial meeting, the said Committee made certain recommendations to the Government of India;
Now, therefore, in exercise of the powers conferred by sub-section (2) of Section 27 of the Insecticides Act, 1968, the Central Government, after considering the recommendation of the Registration Committee, and on being satisfied that the use of Aldrin, Chlordane and Heptachlor is likely to cause risk to human beings and animals, hereby makes the following order, namely:
(1) the manufacture, import and use of Heptachlor and Chlordane shall be prohibited in India with immediate effect;
(2) the certificate of registration issued by the Registration Committee to various persons under Section 9 of the said insecticides shall stand cancelled and the validity of the manufacturing licences issued to them by the Licensing Officer shall also stand cancelled;
(3) the use of Aldrin shall be prohibited in India and the certificate of registration issued under the said Act shall stand cancelled.
(7)
Ministry of Agriculture (Deptt. of Agriculture and Cooperation),
Noti. No. S.O. 190(E), dated March 26, 1999
In exercise of the powers conferred by sub-section (2) of Section 27 read with Section 28 of the Insecticides Act, 1968, the Central Government, after considering the recommendations of the Registration Committee and the Expert Committee constituted for the purpose and on being satisfied that the use of Methomyl 12.5% L formulation and phosphamidon 85% SL is likely to cause risk to human beings and animals, hereby makes the following Orders, namely:
(1) after one year from the date of publication of this Order, the manufacture and use of the following pesticides shall be prohibited, namely:
(i) Methomyl 12.5% L formulation;
(ii) Phosphamidon 85% SL.
(2) there shall not be any registration or grant of manufacturing licence for the production or formulation of Methomyl 12.5% L and phosphamidon 85% SL formulations;
(3) the manufacturing licences issued to various registrants of Methomyl 12.5% L and Phosphamidon 85% SL for setting up of manufacturing units shall stand cancelled in respect of those firms or persons which are yet to create facilities for manufacture of the said formulations;
(4) the certificate of registration in respect of Methomyl 12.5% L and Phosphamidon 85% SL in respect of those registrations who are yet to obtain manufacturing licences is hereby cancelled;
(5) the State Government shall have the power to take such steps as it may deem fit for carrying into execution of these Orders in the State concerned.
(8)
Ministry of Agriculture (Deptt. of Agriculture and Cooperation),
Noti. No. S.O. 191(E), dated March 26, 1999
In exercise of the powers conferred by sub-section (2) of Section 27 read with Section 28 of the Insecticides Act, 1968, the Central Government, after considering the recommendations of the Registration Committee and the Expert Committee constituted for the purpose and on being satisfied that the use of Methomyl 24% formulation and phenyl Mercury Acetate is likely to cause risk to human beings and animals, hereby makes the following Order, namely:
(1) from the date of publication of this order, the manufacture and use of the following pesticides shall be prohibited, namely:
(i) Methomyl 24% formulation;
(ii) Phenyl Mercury Acetate;
(2) the State Government shall have the power to take such steps as it may deem fit for carrying into execution of this Order in the State concerned.
(9)
Ministry of Agriculture (Deptt. of Agriculture and Cooperation),
Noti. No. S.O. 1158(E), dated December 26, 2000
Whereas in exercise of the powers conferred by sub-section (2) of Section 27 of the Insecticides Act, 1968 (46 of 1968), a notification was issued by the Government of India in the Ministry of Agriculture (Department of Agriculture and Cooperation) vide Number S.O. 15(E), dated the 1st January, 1996, banning the manufacture and use of technical grade Benzene Hexachloride (BHC) with effect from 31st March, 1997;
And whereas, in the Writ Petition (C) No. 1094 of 1989 with (C) Nos. 2 and 3 of 1997 in the matter of Dr Ashok v. Union of India, Hon'ble Supreme Court struck down the said notification on the ground that there was a lacuna in the Insecticides Act, 1968 owing to which once a substance is specified in the Schedule as contemplated under Section 3(e)(i) then, there is no power for cancelling the registration certificate issued in respect of the same substance even if on a scientific study it appears that the substance in question is grossly detrimental to the human health;
And whereas, the Insecticides (Amendment) Act, 2000 (23 of 2000) has been enacted which, inter alia, has amended sub-section (1) of Section 27 of the Insecticides Act, 1968 rectifying the said lacuna;
Now, therefore, in exercise of the powers conferred by sub-section (2) of Section 27 of the said Act and in supersession of the said notification, except as respects things done or omitted to be done before such supersession, the Central Government, after consultation with Registration Committee, and on being satisfied that the use of technical grade Benzene Hexachloride (BHC) is likely to cause risk to human beings and animals, hereby makes the following order, namely:
1. The manufacture, distribution, transport and use of Benzene Hexachloride (BHC) technical shall be banned completely from the date of publication of this notification in the Official Gazette.
2. There shall be a ban on new registration or manufacturing license for production of Benzene Hexachloride (BHC) technical.
3. Manufacturing licenses issued to various registrants of Benzene Hexachloride (BHC) technical for setting up of manufacturing units shall be cancelled in respect of those firms or persons.
4. The Certificate of Registration for Benzene Hexachloride (BHC) technical respect of those registrants who are yet to obtain their manufacturing licenses shall be cancelled.
5. The State Government may take such steps in their respective jurisdiction as they may deem fit for carrying out the orders contained in this notification.

Whereas a draft order with a view to delete the label claims of certain deemed to be registered pesticides for use on certain specified crops and withdraw certain other deemed to be registered pesticides was published in exercise of the powers conferred by sub-section (2) of Section 27 of the Insecticides Act, 1968 (46 of 1968) under the notification of the Government of India in the Ministry of Agriculture (Department of Agriculture and Cooperation) number S.O. 1747(E), dated the 12th December, 2005 in the Gazette of India, Extraordinary, Part II, Section 3, sub-section (ii), dated the 12th December, 2005, inviting objections or suggestions from all persons likely to be affected thereby, before the expiry of the period of forty-five days from the date on which the copies of the Gazette containing the said notification were made available to the public;
And whereas, copies of the said Gazette were made available to the public on the 12th December, 2005;
And whereas, the objections and suggestions received in respect of the said order have been duly considered by the Government;
Now, therefore, in exercise of the powers conferred by sub-section (2) of Section 27 of the Insecticides Act, 1968 (46 of 1968), the Central Government, after considering the recommendation of the Core Group of Experts and after consultation with the Registration Committee and on being satisfied that further use of Deemed to be Registered Pesticides enumerated below is likely to cause risk to human beings and animals as their safety cannot be fully established for want of complete data asked for from the pesticide industry, hereby make the following order, namely:

(F) Every State Government shall take such steps under the relevant provisions of the said Act and the rules made thereunder as it considers necessary for the execution of this order in the State.
(G) The deletion and/or withdrawal, as the case may be, made by the Government pursuant to this order shall become inoperative as soon as the required complete data for the insecticide(s)) as per the guidelines is generated and submitted by the Pesticide Industry to the Government and accepted by the Registration Committee.
(11)

Whereas a draft order with a view to declare its intention to ban the use of Monocrotophos on vegetables was published in exercise of the powers conferred by sub-section (2) of Section 27 of the Insecticides Act, 1968 (46 of 1968) (hereinafter referred to as the said Act) under the notification of the Government of India in the Ministry of Agriculture (Department of Agriculture and Cooperation), Number S.O. 644(E), dated the 6th May, 2005 in the Gazette of India, Extraordinary, Part II, Section 3, sub-section (ii), dated the 6th May, 2005, inviting objections or suggestions from all persons likely to be affected thereby (hereinafter referred to as the said order), before the expiry of the period of forty-five days from the date on which the copies of the Gazette containing the said notification were made available to the public;
And whereas, copies of the said Gazette were made available to the public on the 6th May, 2005;
And whereas, no objections and suggestions were received from the public in respect of the said order;
Now, therefore, in exercise of the powers conferred by sub-section (2) of Section 27 read with Section 28 of the Insecticides Act, 1968, the Central Government after considering the recommendations of the Expert Group constituted for the said purpose and after consultation with the Registration Committee set up under the said Act, and, on being satisfied that the use of Monocrotophos on vegetables is likely to involve health hazards to human beings, hereby makes the following order, namely:
1. (1) This order may be called the Monocrotophos (Cancellation of Certificate of Registration) Order, 2005.
(2) It shall come into force on and from the date of publication of this Order in the Official Gazette.
2.(1) The use of Monocrotophos on vegetables shall be banned on and from the date of publication of this order.
(2) The certificates of registration granted for Monocrotophos shall be called back by the Registration Committee from all registrants including new registrants for incorporation of the requirement of the warning in bold letters Banned for use on Vegetables on labels and leaflets.
(3) In respect of those registrants who do not return the registration certificate, as per this order within a period of six months with effect from the date of publication of this order, their license granted under Section 13 of the said Act shall not be renewed or action under Section 14 of the Act should be taken.
(4) The State Governments shall have power to take such steps under the relevant provisions of the said Act and the rules made thereunder as they may deem fit for the execution of these orders in the State concerned.

Whereas the Central Government, in exercise of the powers conferred by sub-section (2) of Section 27 of the Insecticides Act, 1968 (46 of 1968) published a draft order for prohibiting the use of Endosulfan in the State of Kerala vide notification of the Government of India in the Ministry of Agriculture (Department of Agriculture and Cooperation) Number S.O. 1533(E), dated the 25th October, 2005, for inviting objections and suggestions from all persons likely to be affected thereby before the expiry of a period of forty-five days from the date on which copies of the Official Gazette containing the said notification were made available to the public;
And whereas, copies of the said Gazette were made available to the public on the 25th October, 2005;
And whereas the objections and suggestions received from the public in respect of the said draft order were duly considered by the Central Government;
Now, therefore, in exercise of the powers conferred by sub-section (2) of Section 27 read with Section 28 of the Insecticides Act, 1968 (46 of 1968), the Central Government hereby makes the following order, namely:
1. (1) This order may be called the Prohibition of use of Endosulfan in the State of Kerala.
(2) It shall come into force on the date of its publication in the Official Gazette.
2. The use of Endosulfan in State of Kerala shall be kept on hold from the date of publication of this notification till such time that the results of the epidemiological study to pin-point the factors responsible for the health problems in village Padre become available and a decision thereon is taken by the Central Government.
3. The State Government of Kerala shall take all such steps in its jurisdiction as it may deem fit for carrying out execution of this order as per the provisions contained in the Insecticides Act, 1968 (46 of 1968) and the rules framed thereunder.
4. It is hereby clarified that this order for putting on hold of the use of Endosulfan in the State of Kerala is without prejudice to the directions of the Hon'ble High Court of Kerala in their judgment in O.P. No. 20716 of 2002, O.P. No. 29371 of 2001 V, O.P. No. 16300 of 2001, O.P. No. 17026 of 2002 and WP (C) No. 24110 of 2004, dated the 17th March, 2006.

Ministry of Agriculture (Deptt. of Agriculture and Cooperation),

Whereas, the Central Government, in exercise of the powers conferred by sub-section (2) of Section 27 of the Insecticides Act, 1968 (46 of 1968), published a Draft Order to ban the use of Fenitrothion in agriculture except for locust control in scheduled desert area and public health vide notification of the Government of India in the Ministry of Agriculture (Department of Agriculture and Cooperation), Number GSR 59(E), dated the 1st February, 2007, for inviting objections and suggestions from all persons likely to be affected thereby before the expiry of a period of forty-five days from the date on which copies of the Official Gazette containing the said notification were made available to the public;
And, whereas, copies of the said Gazette were made available to the public on the 1st day of February, 2007;
And, whereas, no objections and suggestions were received from the public in respect of the said Draft Order;
Now, therefore, in exercise of the powers conferred by sub-section (2) of Section 27 read with Section 28 of the Insecticides Act, 1968 (46 of 1968), the Central Government hereby makes the following order, namely:
1. (1) This order may be called the Use of Fenitrothion Order, 2007.
(2) It shall come into force on the date of their publication in the Gazette of India.
2. (1) The use of Fenitrothion shall be banned in agriculture except for locust control in scheduled desert area and public health.
(2) The Certificates of Registration granted for Fenitrothion shall be called back by the Registration Committee from all registrants including new registrants for incorporation of the requirement of the warning in bold letters Banned for use on Agriculture on labels and leaflets.
(3) In respect of those registrations who do not return the registration certificate, as per this order within a period of six months from the date of publication of the final notification, the licence granted to all the registrants under Section 13 of the Insecticides Act shall not be renewed or action under Section 14 of the said Act will be taken.
3. Every State Government shall take all such steps under the relevant provisions of the said Act and the rules made thereunder, as it considers necessary for the execution of this order in the State.
(14)
Ministry of Agriculture (Deptt. of Agriculture and Cooperation),
Noti. No. S.O. 1472(E), dated August 29, 2007
Whereas, the Central Government, in exercise of the powers conferred by sub-section (2) of Section 2 of the Insecticides Act, 1968 (46 of 1968), published a draft Order to prohibit the import, manufacture and use of Lindane (Gama BHC) except for termite control in buildings including wood, termite control in agriculture as per the approved label claims by the Registration Committee and for export vide notification of the Government of India in the Ministry of Agriculture (Department of Agriculture and Cooperation) Number S.O. 1532(E) dated the 25th October, 2005 for inviting objections and suggestions from all persons likely to be affected thereby before the expiry of a period of forty-five days from the date on which copies of the Official Gazette containing the said notification were made available to the public;
And, whereas, copies of the said Gazette were made available to the public on the 25th day of October, 2005;
And, whereas, the objections and suggestions received from the public in respect of the said draft Order were duly considered by the Central Government;
Now, therefore, in exercise of the powers conferred by sub-section (2) of Section 27 read with Section 28 of the Insecticides Act, 1968 (46 of 1968), the Central Government hereby makes the following order, namely:
1. (1) This Order may be called the Restriction of Import, Manufacture and Use of Lindane (Gamma B.H.C.) Order, 2007.
(2) It shall come into force on the date of its publication in the Official Gazette.
2. No person shall import, manufacture or use Lindane except
(i) for termite control in building including wood;
(ii) for termite control in agriculture as per the approved label claims by the Registration Committee; and
(iii) for exports.
3. (1) All Certificates of registration granted for Lindane shall be called back by the Registration Committee from all registrants including new registrants for incorporation of the requirement of the warning in bold letters only for use in terminate control in buildings including wood, termite control in agriculture as per approved label claims by the Registration Committee and for exports on labels and leaflets.
(2) If any person fails to return the certificate of registration, as per this order within a period of six months from the date of publication of this notification, the license granted to him under Section 13 of the said Act shall not be renewed and action under Section 14 of the said Act shall be taken.
4. Every State Government shall take all such steps under the provisions of the said Act and the rules made thereunder, as it considers necessary for the execution of this Order in the State.

Whereas, the Central Government, in exercise of the powers conferred by sub-section (2) of Section 27 of the Insecticides Act, 1968 (46 of 1968), published a draft Order to ban the use of Diazinon in Agriculture except for house hold use vide notification of the Government of India in the Ministry of Agriculture (Department of Agriculture and Cooperation), Number S.O. 1687(E), dated the 1st October, 2007 for inviting objections and suggestions from all persons likely to be affected thereby before the expiry of a period of forty-five days from the date on which copies of the Official Gazette containing the said notification were made available to the public;
And whereas, copies of the said Gazette were made available to the public on the 1st day of October, 2007;
And whereas, no objections and suggestions were received from the public in respect of the said draft order;
Now, therefore, in exercise of the powers conferred by sub-section (2) of Section 27 read with Section 28 of the Insecticides Act, 1968 (46 of 1968), the Central Government hereby makes the following order, namely:
1. (1) This order may be called the Restriction on Use of Diazinon Order, 2007.

(3) If any person who holds the certificate of registration fails to return the certificate to the Registration Committee, referred to in clause (2), within a period of six months, the certificate of registration granted to them shall not be renewed or action shall be taken under Section 14 of the said Act.
3. Every State Government shall take all such steps under the provisions of the said Act and the rules made thereunder, as it considers necessary for the execution of this order in the State.

Whereas, the Central Government, in exercise of the powers conferred by sub-section (2) of Section 27 of the Insecticides Act, 1968 (46 of 1968), published a draft order to withdraw the use of Metoxuron vide notification of the Government of India in the Ministry of Agriculture (Department of Agriculture and Cooperation), Number S.O. 1689(E), dated the 1st October, 2007 for inviting objections and suggestions from all persons likely to be affected thereby before the expiry of a period of forty-five days from the date on which copies of the Official Gazette containing the said notification were made available to the public;
And whereas, copies of the said Gazette were made available to the public on the 1st day of October, 2007;
And whereas, no objections and suggestions were received from the public in respect of the said draft order;
Now, therefore, in exercise of the powers conferred by sub-section (2) of Section 27 read with Section 28 of the Insecticides Act, 1968 (46 of 1968), the Central Government hereby makes the following order, namely:
1. (1) This order may be called the Withdrawal of Metoxuron Order, 2007.
(2) It shall come into force on the date of its publication in the Official Gazette.
(3) The Registration Committee shall call back the certificates of registration granted for Metoxuron from all registrants including new registrants.
(4) If any person who holds the certificate of registration fails to return the certificate to the Registration Committee, referred to in clause (3), within a period of six months action shall be taken under Section 14 of the said Act.
2. Every State Government shall take all such steps under the provisions of the said Act and the rules made thereunder, as it considers necessary for the execution of this order in the State.

Whereas, the Central Government, in exercise of the powers conferred by sub-section (2) of Section 27 of the Insecticides Act, 1968 (46 of 1968) published a draft Order for declaring its intention to prohibit the use of Dazomet in tea vide notification of the Government of India in the Ministry of Agriculture (Department of Agriculture and Cooperation) number S.O. 1792(E) dated the 23rd October, 2007, and invited objections and suggestions from all persons likely to be affected thereby, till the expiry of a period of forty-five days from the date on which copies of the Official Gazette in which the said notification was published were made available to the public;
And whereas, copies of the said Gazette were made available to the public on the 26th day of October, 2007;
And whereas, the objection received in respect of the said draft order was duly considered by the Central Government;
Now, therefore, in exercise of the powers conferred by sub-section (2) of Section 27 read with Section 28 of the Insecticides Act, 1968 (46 of 1968), the Central Government hereby makes the following Order, namely:
1. This Order may be called the Restriction on Use of Dazomet Order, 2008.
2. Use of Dazomet is not permitted on tea.
3. All the holders of certificate of registration shall return the certificates of registration to the Registration Committee for incorporation of the warning in bold letters Not Permitted for Use in Tea on lables and leaflets.
4. If any person who holds the certificate of registration fails to return the certificate to the Registration Committee, referred to in clause (3), within a period of six months, the certificate of registration granted to them shall not be renewed or action shall be taken under Section 14 of the said Act.
5. Every State Government shall take all such steps under the provisions of the said Act and the rules made thereunder, as it considers necessary for the execution of this Order in the State.

Whereas, the Central Government, in exercise of the powers conferred by sub-section (2) of Section 27 of the Insecticides Act, 1968 (46 of 1968) published a draft Order for declaring its intention to prohibit the manufacture, import and use of Chlorofenvinphos vide notification of the Government of India in the Ministry of Agriculture (Department of Agriculture and Cooperation) number S.O. 1793(E), dated the 23rd October, 2007 and invited objections and suggestions from all persons likely to be affected thereby, till the expiry of a period of forty-five days from the date on which copies of the Official Gazette in which the said notification was published were made available to the public;
And whereas, copies of the said Gazette were made available to the public on the 26th day of October, 2007;
As whereas, no objections and suggestions were received from the public in respect of the said Draft Order;
Now, therefore, in exercise of the powers conferred by sub-section (2) of Section 27 read with Section 28 of the Insecticides Act, 1968 (46 of 1968), the Central Government hereby makes the following Order, namely:
1. This Order may be called the Banning of Chlorofenvinphos Order, 2008.
2. No person shall manufacture, import and use Chlorofenvinphos.
3. The Registration Committee shall call back the certificates of registration granted for Chlorofenvinphos from all registrants including new registrants.
4. If any person who holds the certificate of registration fails to return the certificate to the Registration Committee, referred to in clause (3), within a period of six months, action shall be taken under Section 14 of the said Act.
5. Every State Government shall take all such steps under the provisions of the said Act and the rules made thereunder, as it considers necessary for the execution of this Order in the State.
(20)
Ministry of Agriculture (Deptt. of Agriculture and Co-operation),
Noti. No. S.O. 166(E), dated January 22, 2010
Whereas, the Registration Committee constituted under Section 5 of the Insecticides Act, 1968 decided in its 261st meeting held on 15-2-2006 that the guidelines for minimum infrastructural facilities to be created by the manufacturers as suggested by the Expert Group shall be enclosed with all Certificates of Registration of chemical pesticides for guidance to licensing authorities of the State Department to issue manufacturing licenses;
And whereas, the joint team constituted to inspect and check the insecticides manufacturing premises in the State of Haryana with respect to the fulfilment of minimum infrastructure facilities necessary for manufacturing of pesticides found that certain manufacturers were not maintaining the minimum infrastructure facilities required for the manufacture of insecticides in their premises;
And whereas, show cause notices were issued to such manufacturers as to why the various Certificates of Registration granted to them should not be cancelled;
And whereas, the Registration Committee in its 293rd meeting held on 26-9-2008 decided that the Certificates of Registration of manufactures who have not complied with the minimum infrastructure facilities for pesticides, may be withdrawn;
Now, therefore, in exercise of the powers conferred by sub-section (2) of Section 27 read with Section 28 of the Insecticides Act, 1968 (46 of 1968), the Central Government, after considering the recommendation of the Registration Committee and on being satisfied that the manufacturers specified in this order have not complied with the minimum infrastructural facilities for pesticides and thereby endangered public safety, hereby makes the following order, namely
1. (1) This order may be called the Cancellation of Certificate of Registration Order, 2010.
(2) It shall come into force on the date of its publication in the Official Gazette.
2. The Certificates of Registration issued by the Registration Committee to the following manufacturers shall stand cancelled
(1) M/s Jyoti Insecticides, Ishwar Industries Building, Charkhi Dadri, Bhiwani (Haryana).
(2) M/s Mahamaya Life Sciences (P) Ltd., 1360, MIE, Bahadurgarh (Haryana).
3. The State Government of Haryana shall take all such steps in its jurisdiction as it may deem fit for carrying out execution of this order as per the provisions contained in the Insecticides Act, 1968 (46 of 1968) and the rules framed thereunder.
(21)
Ministry of Agriculture (Deptt. of Agriculture and Co-operation),
Noti. No. S.O. 637(E), dated March 25, 2011
Whereas, the Central Government, in exercise of the powers conferred by sub-section (2) of Section 27 of the Insecticides Act, 1968 (46 of 1968) published a draft Order for Banning of Lindane vide notification of the Government of India in the Ministry of Agriculture (Department of Agriculture and Cooperation), number S.O. 2088(E), dated the 26th August, 2010, and invited objections and suggestions from all persons likely to be affected thereby, till the expiry of a period of forty-five days from the date on which copies of the Official Gazette containing the draft order where made available to the public;
And whereas, copies of the said Gazette were made available to the public on the 20th day of September, 2010;
And whereas, the objections received in respect of the said draft order were duly considered by the Central Government;
Now, therefore, in exercise of the powers conferred by sub-section (2) of Section 27 read with Section 28 of the Insecticides Act, 1968 (46 of 1968), the Central Government hereby makes the following order, namely
1. (1) This order may be called the Banning of Lindane Order, 2011.
(2) It shall come into force on the date of publication of this order in the Official Gazette.
2. No person shall manufacture, import or formulate Lindane from the date of publication of this order in the Official Gazette.
3. No person shall use Lindane after the period of two years from the date of publication of this order in the Official Gazette.
4. The certificates of registration for Lindane granted under the Section 9 of the said Act shall be deemed to have been cancelled.
5. Every State Government shall take all such steps under the provisions of the said Act and the rules framed thereunder, as it considers necessary for the execution of this order in the State.
(22)
Ministry of Agriculture (Deptt. of Agriculture and Co-operation),
Noti. No. G.S.R. 166(E), dated March 12, 2013
In exercise of the powers conferred by proviso to Section 16 of the Insecticides Act, 1968 (46 of 1968), read with Rule 5 of the Insecticides Rules, 1971, the Central Government hereby directs that the following functions of the Central Insecticides Laboratory in respect of bio-pesticides shall be carried out by National Institute of Plant Health Management, Hyderabad, namely
(a) to analyse such samples of Bio pesticides sent to it under the Act by any officer or authority authorized by the Central or State Governments and submission of certificates of analysis to the concerned authority;
(b) to analyse samples of Bio pesticides for chemical substance under the provisions of the Act;
(c) to carry out such post registration investigations as may be necessary for the purpose of ensuring the conditions of Registration of Pesticides;
(d) to determine the efficacy and toxicity of registered Bio pesticides.
(23)

Whereas, the Stockholm Convention on Persistent Organic Pollutants (hereinafter referred to as said Convention) came into force from 17th May, 2004 and India ratified the said convention in the year 2006;
And whereas, Mirex has been listed as Persistent Organic Pollutants (POP) in Annex A of the Convention;
And whereas, Mirex has not registered as an insecticide under the provision of the Insecticides Act, 1968;
And whereas, the Registration Committee in its 342nd meeting held on 27-9-2013 has recommended in its minutes dated 27-9-2013 for banning the Mirex;
Now, therefore, in exercise of the powers conferred by clause (a) of sub-section (1) of Section 18 read with sub-section (2) of Section 27 and Section 28 of the Insecticides Act, 1968 (46 of 1968), the Central Government on being satisfied that the use of Mirex involves health hazards to human beings or animals, hereby makes the following order, namely
1. (1) This order may be called the Banning of Mirex Order, 2014.
(2) It shall come into force from the date of its publication in the Official Gazette.
2. No person, by himself or by any person on his behalf, shall manufacture, formulate, distribute, stock, sell, import, export, transport or use or caused to be used by any worker, Mirex in any form.
3. Every State Government shall take necessary steps, under the Insecticides Act, 1968 or rules made thereunder, to prevent the use of Mirex in any form, as it considers necessary for enforcing this Order. Any violation of this Order may be dealt with in accordance with the provision of the Insecticides Act, 1968 or rules made thereunder.
4. Notwithstanding anything contained in the foregoing paragraphs, Mirex may be imported and used in the quantities required for research and development activities with the prior approval of the Central Insecticides Board and Registration Committee constituted under the Insecticide Act, 1968.

Now, therefore, in exercise of the powers conferred by sub-section (2) of Section 27 read with Section 28 of the Insecticides Act, 1968 (46 of 1968), the Central Government on being satisfied that the use of Hexachlorobenzene involves health hazards to human beings or animals, hereby makes the following order, namely
1. (1) This order may be called the Banning of Hexachlorobenzene Order, 2014.
(2) It shall come into force from the date of its publication in the Official Gazette.
2. No person, by himself or by any person on his behalf, shall manufacture, formulate, distribute, stock, sell, import, export, transport or use or caused to be used by any worker, Hexachlorobenzene in any form.
3. Every State Government shall take necessary steps, under the Insecticides Act, 1968 or rules made thereunder, to prevent the use of Hexachlorobenzene in any form, as it considers necessary for enforcing this order. Any violation of this order may be dealt with in accordance with the provision of the Insecticides Act, 1968 or rules made thereunder.
4. Notwithstanding anything contained in the foregoing paragraphs, Hexachlorobenzene may be imported and used in the quantities required for research and development activities with the prior approval of the Central Insecticides Board and Registration Committee constituted under the Insecticide Act, 1968.

Whereas, manufacturers of insecticides were advised from time to time to generate and submit data for fixation of Maximum Residue Limits (MRLs) in respect of insecticides whose MRLs are not fixed but are available in the market for use;
And whereas, Registration Committee after examination of information available on the subject of fixation of MRLs of insecticides recommended deletion of crops from the label and leaflets of insecticides for which MRLs have not been fixed;

(B) All registrants granted certificate of registration in respect of the abovementioned insecticides shall submit their certificate of registration along with label/leaflets for deletion of label claims on the abovementioned crops to the Secretary, Central Insecticides Board and Registration Committee, NH-IV, Faridabad, within six months from the date of publication of this order, failing which action to revoke licenses under Section 14 of the Insecticides Act, 1968 shall be initiated.
(C) Non-endorsement or correction in the certificate of registration will not to be taken as permission or approval to operate upon such certificates of registration in contravention of the provisions of this order.
(D) Certificate of registration not submitted by the due date shall be deemed to have been cancelled.
(E) Every State Government shall take such steps in their respective States as they may deem fit for carrying out the provisions of this order.
(F) The Central Government shall consider revival of such label claims as deleted pursuant to this order after fixation of MRLs by competent authority of Food Safety and Standards Authority of India.
(26)
Ministry of Agriculture and Farmers Welfare (Department of Agriculture, Co-operation and Farmers Welfare), Noti. No. S.O. 1370(E), dated March 6, 2018
In exercise of the powers conferred by sub-section (2) of Section 38 of the Insecticides Act, 1968 (46 of 1968), the Central Government hereby exempts the National Accreditation Board for Testing and Calibration Laboratories (NABL) accredited laboratories of the following organizations shall be exempted from the provisions of said Act, namely
i. Indian Council for Agricultural Research (ICAR);
ii. State Agriculture Universities (SAU's);
iii. Institutions of Department of Agriculture, Cooperation and Farmers Welfare;
iv. Department of Science and Technology (DST); and
v. Department of Scientific and Industrial Research (DSIR).
2. The above exemption referred to in Paragraph 1 shall be for the purpose of importing insecticides or pesticides to the tune of up to ten kilograms in a calendar year, for Research and Development activities and registration related data generation, subject to following conditions, namely
i. The authorized signatory of the laboratories shall inform the Central Insecticides Board & Registration Committee regarding the import details as specified in the format annexed to this notification.
ii. The laboratory shall inform about the Research & Development work carried out with the imported quantum of insecticides or pesticides.
iii. The laboratories shall give an undertaking that the imported quantity of insecticides or pesticides shall be used only for research and development activities and registration related data generation and shall not be used in any manner for commercial activities, failing which the laboratories shall be liable to prosecuted under the provisions of Insecticides Act, 1968 and the Insecticides Rules, 1971.
3. This notification shall come into force on the date of their publication in the Official Gazette.
