Act

to repeal certain laws and to amend certain other laws in force in the whole or any part of the State of Rajasthan.

Be it enacted by the Rajasthan State Legislature in the Thirteenth Year of the Republic of India as follows:

Section 1. Short title

This Act may be called the Rajasthan Laws Repealing and Amending Act, 1962.

Section 2. Repeal of certain laws

The Laws specified in the First Schedude are hereby repealed to the extent mentioned in the fourth column thereof.

Section 3. Amendment of certain laws

The laws specified in the Second Schedule are hereby amended to the extent and in the manner mentioned in the fouth column thereof.

Section 4. Savings

(i) The repeal by this Act of any law shall not affect any other law in which the law hereby repealed has been applied, incorporated or referred to.

(2) This Act shall not affect the previous operations of any law hereby repealed or the validity, invalidity, effect or consequence of anything already done or suffered thereunder or any right, title, prililege, obligation or liability already acquired, accrued or incurred there under or any investigation, remedy or proceeding in respect thereof or any release or discharge of or from any debt, penalty, obligation, liability, claim or demand or any indemnity already granted, or the proof of any past act or thing

(3) This Act shall not affect any principle or rule of law, or established jurisdiction, from or course of pleading, practice or procedure, or any existing usage, custom, privilege, restriction, exemption, office or appointment, notwithstanding that the same respectively may have been in any manner affirmed, or recognised or derived by, in or from any law hereby repealed.

(4) The repeal by this Act of any law shall not revive or restore any jurisdiction, office, custom, liability, right, title, privilege, restriction, exemption, usage, practice, procedure or other matter or thing not existing or in force on the date on which this Act comes into force.

(5) For the removal of doubt it is hereby declared that, where this Act repeals any law by which the text of any other law was amended by the express omission, insertion or substitution of any matter, the repeal shall not affect the continuance of any such amendment made by the law so repealed and in operation at the commencement of this Act,

In section 21, (a) after the words The Board may the words and commas subject to any general or special directions issued by the State Government, shall be inserted and (b) the following proviso shall be added: Provided that the Board may, subject as aforesaid, direct that one person shall be appointed to discharge the duties of any two or more offices.
1959	35	The Rajasthan Urban Improvement Act, 1959.	In section 24, (a) Subject to any general or special direction issued by the State Government, shall be inserted before the words Every Trust , and (b) the following proviso shall be added: Provided that the Trust may, subject as aforesaid, direct that one person shall be appointed to discharge the duties of any two or more offices .
1961	22	The Rajasthan Samaj Shikshan Board Act, 1961.	In sub-section (3) of section 19, (a) after the word the words and a comma shall be inserted, and (b) the following proviso shall be added:
1961	38	The Rajasthan Agricultural Produce Markets Act, 1961.	In section 14, for the word and figure section 6 , the words, letter, figures and brackets clause (b) of sub-section (2) of section 9 shall be substituted.
