Act further to amend the Goalpara Tenancy Act, 1929.
Whereas it is expedient further to amend the Goalpara Tenancy Act, 1929;
And whereas the previous sanction of the Governor General, required by sub-section (3) of section BOA of the Government of India Act, has been obtained to the passing of this Act.
It is hereby enacted as foUows :- 1. This Act may be called the Goalpara
Tenancy (Amendment) Act, 1936. 2. The words "within six months of the
transfer" in section 8, sub-section (1) of the Goalpara Tenancy Act, 1929 (hereinafter referred to as the principal Act) shall be deleted.
3. The word "entertained" in section 8, sub-section (2) of the principal Act shall be replaced by the words " decreed or granted."
4. The entire sub-section (3) of section 8 of the principal Act shall be deleted.
5. The word "shall" in the sub-clause (ii) of the second proviso to sub-section (1) of section 57 of the principal Act shall be replaced by the word ' may ' and in the same sub-clause the words "at the rate mentioned in section 56" shall be replaced by the words ''at the rate the Court may direct".
