22. The provisions of O.dcr XXI, Rules 46 to 53 of the Code ofCivil Procedure, l90B(V of 1908) reg:urding the attadin~ent of tltt: several das,..es of movable property dealt with in those rules shall, as far as may be, apply to the attachement made under this Code.
23. (I) Where the propety :s immov?.be, the atlachemcnt shall be made by an order prohibiting tl1e dcfaul!er from transferring or charsging the property in any way, and all persons from taking any benefit from such transfer or, charge.
(2) The order shall be proclaimed at some place on or ndjecent to such property by beat of drum or other customary mode, and a copy of the order sh all be affiixed oi1 a conspicious part of the· property and then on the notice
board of the office of the Revenue Officer. (3). The order 8hall take effect as against purchasers for value in good fai:th from the date when a copy of the order is affixed on the property and against all other transferees from the defaulter from the date on which such mrler is made.
. 24. (1) If any daim is set up by a third person to the property atta~,ed or proceeded against under the provisions of this Code, the Revenue Officer shall enquire int() the claim and mav admit or rt>ject. it. ' .

SALE GENERALLY
25. Every ~ale shall be conducted by an officer or other person _appoi~ted by a general or special order in this behalf and shall be made by pubhc auction.
. 26. (I) The Revenue Officer shall came a proclamation of the _ill.tended sale to be made statiug the time and place of sale and specifying as fairly and ·acc!:uratdy a!: possible-

27. The Revenue Officer may, if he consider, this ucccs::iary, summo11 the defaulter and examine him with respect to any matters to be ir,cluded in the sale proclamation.
28. Save ill the case of property of the kind descriLecl in the fim provisu to rule 19, no sale hereunder shall, without the- c-onsent in writing of the defaulter, take place-
(,) on Sunday or on any authorised civil court holiday or on any day declared as a local holiday for the area in which
the sale is to be held; and
(ii) until after the expiration of at least thirty days from the date on which the proclamation thereof v. as made.
29. (I) The Revenue Officer may, in his discretion, adjourn any sale hereunder to a s~ified day and hour and the officer conducting any' such sale may, in his discretion, adjourn tho.; sale recording his n:asons for such adjourn- ment:
Provided that where the order of the Revenue Officer can be obtamed in time, no such adjournment shall be made without sucli. order.
(2) Where a sale is adjourned under sub-rule (I) for a longt:"r period than fifteen days, a fresh proclamation shall be made wiless the defaulter consents to waive it.

41. At any time within thirty days from the date of sale, any person whose interests are affected by such sale may apply to the Revenue Officer to set aside the sale on the ground of some material irregularity or mistake in publishing or conducting it, and the Revenue Officer may, after giving notice to the persons aflCcted thereby, pass an order setting aside the sale and may order resale; but no sale shall be se-t aside on such grouhds unless the applicant proves to tlie satisfaction of thf' Revenuf" Officer that he has sustained substantial injury by such irregularity or mistake. _ 42. Except in a case where land has been sold for an ears, which form a charge on the lar:td, the purchaser may, at any time within thirty days from the date of sale, apply to the Revenue Officer to set aside the sale on the ground that the defaulter f.,ad no saleable interestin the propenY sold and Lhe Revenue Officer shall, after due inquiry, pass such orders on such_ application as he deem~ fit,

46. If the sale of any property is set aside under rulr, 40, ,f I ,42, or 44 the amrnmt of purchase money deposited by the purchaser shall be refunded to hitn.
CERTIFICATE OF PURCHASE AND DELIVERY OF POSSESSION
47. If the sale of any immovable prorerty has been confirmed, the Rcv.enue Officer shall grant a certificate to the purchaser specifying the date on which the !tale is confirmed, the property sold, and the name of the pur- . chaser and shall put the purc~aser in possession of such prnperty, 4H. (I) Where the purchaser is resisted or obstructed by any person in obtaining possession of the property, he may make an application to tht"
Revenue Officer complaining of such resistance or obstruction.
(2) The Revenue Officer shall fix a date for investigating the mattet and shall summon the party against whom the applka tion is made to appear and answer the same.
49. Where the Revenue Officer is satisfied that thi: resistanr;t" or ob- struction was occasioned-

~ An A<:t to amend the Chhattisgarh and Revenue Code, 1959 (No. 2o of 1959).
'-,_ Be it enacted by the Chhattisgarh Legislalure in the 53rd Year of the republic oflndia as follows:~
l. (I) This Ad.hi11iyam may be called the Chhattisgarh Land Revenue code (Amend- mem) Adhiniyam, 2002. ,
(2) It shall come into force from the date of its publication in the Gazette.
2. After entry (vii) of clause (Z-l) of Sub-section (1) of Section 2 of the Chhatti5garh Land Revenue Code, 1959 (No. 20 of 1959), (Herc in after referred as the Principal Act) the following entries shalt"be inserted, namely :-

Permanent lease for such Bhata Land, on which the provisions of the Forest, Con- servation Act, 1980 (No. 69 of 1980) shall not apply may be grante.1. An agreement can be executed for plan ta.ti on on Bade Jhad/Chh ote Jhad Ka Jungle. No bhumiswami right shall accrue to the agreement holder or of his/her heir of the Land of Bade Jhad/Chhote Jhad Ka Jungle and on che trees planted on the above land. The agreemcn t holder or his/her heir shall be entitled to on! y usuftuct of the trees"
In the Sub-section (4) of Section 241 of the Principal Act for the words "One thousand rupees·· the words ''Five thousand rupees" sh.ill be substituted. ,. -
(2) At Che end of Sub-section (5) of Section 241, of the Principal Act, the foJlowing · words shall be added, namely :-
"However such person shaJJ be required to get his land demarcated by the competent authority and to infonn in writing the Revenue Officer and Range Forest Officer having Jurisdiction a1lcast 10 days before felling of removal of such trees"

An Act to further amend.the Chhattisgarh Land Revenue Code 19S9 (No, 20 of 1!1S9).
Be it enacted by the Cbhattisgarh Legislature in the fifty-fourth year of the Republic of India as follows:-
Short 'fill;:aud Com- l. ( 1) This Act may b:e called the Chhattisgarh Land Revenue Code (Amendment) Act, 2003. meucement.
(2) It shall come into force from 23rd November 2002 (Twenty third November Two Thusand Two).
Amendment in Sec- 2. Section 3 of the Chhattisgarh Land Revenue Code 1959 (No. 20 of 1959) (Here in after referred lion 1 . as the Code) shall be substituted by the following :- ·

( l) There shall be a Board of Revenue for Chhattisgarh having a President.
(2) In addition to the President, the State Government may appoint as many memben as it may deem fit -
Section 10 of the Code shall be substituted by the following. :-

All appeals, applications for revision, review and other proceedings under the Code pending before the Board of Revenue of Madhya Pradesh, relating to the State of Chhattisgarh on 3 t st October 2002 shall stand transfened to and, be heard and decided by the Board of Revenue of Cbhatrisgarh. ·
All appeals, applications for revision, review and other proceedings under the Code pending as on 23rd November, 2002 before the Commissioners and Additional Commissioners, shall stand transferred to and, be heard and decided by the Board of Revenue. ·
Provided that all bona fide decisions, proceedings and actions taken by the Commissioners or6e Additional Commissioners appointed under the Code after the 22nd November, 2002 till they relinquished office, shall be deemed to be legal and valid .

4. The following words appearing in Section 11 of the Code shall be omitted :-

(2) In clause (g) of Sub-section ( 1) of Section 44, of the Code the word "Commi- ssioner or the" shall be omitted.
(3) In clause (i) of Sub-section (2) of Section 44, of the code for the word "Commi- ssiqner" the words "Board of Revenue" shall be substituted. ( 4) clause (iii) of Sub-section (2) of Section 44 of the code shall be omitted.
11. . Sub-section (b) of Section 4 7 of the Code shall be omitted.
12. Sub-section (3) of Section 49 of the Code shall be substituted by the following:-
~(3) After hearing the pa1ties, the Appellate Authority may confirm, vary or rev~rse the order upp~u led ag~1inst; or may take such additional evidence as it may consider necessary for passing its order. ·
Provided that the Appellate Authority shall not remand the case for disposal by any Revenue Officer subordinate to it."

(No. 6 of 2005) CHHATI'JSGARH LAND REVENUE CODE (AMENDMENT) ACT, 2005 An Act further to amend the Chhattisgarh Land Revenue Code, 1959 (No. 20 of 1959) Be it enacted by the Chhattisgarh Legislature in the fifty sixth year of the Republic of India as follows :-
l. (1) This Act may be called the ~hhattisgarh Land Revenue Code, (Amendment) Act, 2005 (No. 6 of 2005).
(2) 11 sba11 come into force from the date of its publication in the Official Gazette.
2. For sub-- section (2) of section 44 of the Chhattisgarh Land Revenue Code, 1959 (No. 20 of 1959) (hereinafter ref erred to as the Code) the following sub-section shall be substituted, namely:-
"(2) Save as otherwise provided .1. second appeal shall lie against every_ order passed iri first appeal under this code or the rules made thereunder :.:....... _ ·
(i) if such order is passed ,.,y the Sub-Divisional Officer:___to the Collector;
(ii) if such order is passed by ihe Collector-to the Board;

Be ii enacted by the Chhattisgarh Legislature in the Sixty-second ye;n- of the Republic of India, as follows :-

(I) This Act may be called the Chhanisgarh Land Revenue Cod,- {Amendment) Act, 201 I. - -
(2) It shall come into force from the dat.e of its publication in the Official Gazette.
(2)
After clause (e) of sub-section (1) of Section 59 of the Chhanisgarh La.rid ► Revenue Code, 1959 (No. 20 of 1959), (hereinafter referred to as the Princi- pal Act), the following clauses shall be inserted, namely:-
'"(f), (g) and (h)."
After clause (e) of sub-section (I) of Section 59, the following clauses shall be inserted, namely:-
"(f) Residential Colony/Project; -
(g) Public/Institutional Purpose;
(h) Medical Facilities Center.•
(3) After proviso to sub-section (2) of Section 59 the. following proviso shaJI be inserted, namely:-
"Provided f unher that the Nay a Raipur Development Authority shall be ex- empted from re-assessment for the diversion of land."
(4) In sub-section (5) of Section 59 of the Principal Act, for· the words ''Sub- Divisional Officer" the words "Competent Authority" shall be substituted.
(I) ln Section 172 of the Principal Act, for the words "Sub-Divisional_ Officer"wherever they occur the words ''C.ompetent Authority" shall be subs- tituted.
(2) In sub-section ( 4) of Section 172 of the Principal Act, for the words "two hundred rupees" the words "one thousand rupees" shall be substituted. - --i,,,
(3) In sub-section (5) of Section 172 of the Principal Act, for the words "two hundred rupees" and "twenty rupees" the words "one thousand rupees" and
"one hundred rupees" shall be subsituted. ( 4) In sub-section ( 6-a) of Section 172 of the Principal Act, for the words "one hundred rupees" the words "five hundred rupees" shall be substituted. In sub-section ( 4) of Section 241 of the Principal Act, for the words "five thousand rupees" the words "twenty five thousand rupees" shall be substituted. In proviso to sub-section (7) of Section 247 of the Principal Act, for the words "one thousand rupees" wherever they occur the words "twenty five thousand rupees" shall be substituted.

Provided that. where an improvement has been effected at any time in any holding held for the purpose of agriculture by or at the expense of the holder thereof, the assessment of such holding shall be fixed as if the improvement had not been made."
In sub-section ( l) of ection 119 of the Principal Act, for the word ''twenty- five", the words "one thousand rupees" shall be sub tituted .
(2) After sub-section (I) of Section 119 of the Principal Act, the following shall be inserted, namely :-
"( I-A) As required under Section 112, if Registering Officer does not provide the information prescribed under rules made under Section 110 within one month then Tahsildar may impose fine not exceed- ing five thousand rupees. which shall be recoverable as arrears of land revenue."
In sub-section (2) of Section 128 of the Principal Act, for the word "one rupee", the words "one hundred rupees" hall be substituted.
In section l30 of the Principal Act , for the word "fifty", lhe words "five thousand" shall be substituted.
In Section 132 of the Principal Act, for the word "one thou and", the words "ten thousand" shall be substituted.
For Section 133 of the Principal Act, the following shall be substituted . namely :-
"133. Removal of obstruction.- If a Tah ildar finds that any obstacle impedes the free use of a recognized road, path or common land of a village or impede the road or source of water which has been lhe subject of a decision under Section 131, he may order the person responsible for such obstacle to remove it and jf such person fails to comply with the order, he may cause the obstacle to be removed and may recover from such person the cost of removal thereof and such person shall be liable, under the written order of Tahsildar stating the facts and circumstances of the case, to a penalty which may extend to ten thousand rupees".
Ln Section 143 of the Principal Act, the word '"ten percent" shall be omitted. After sub-section (4) of Section 165 of the Principal Act, the following shall be inserted, namely :-
"(4-A). (i) Notwichstanding anything contained in sub-section (1 ), Bhumiswami shall not transfer his land held for agriculture 10 any person who is not a bona.fide agriculturist.
Explanation- For the purpose of this sub-section, the ex.pression
"lransfer'' shall not include the following, namely :-
(a) transfer by way of inheritance;
(b) transfer to legal heirs by way of will;
(c) land acquisition in public interest; {d) transfer to or for any religious or charitable pur- pose, for trust, health, culture purpose, educational institutions;

(ii) The State Government may, by notification, makes rules for carrying out the provisions of thi uh-section."
For second proviso to sub- ection ( 1) of Section l 72 of the Principal Act, the following shall be substituted, namely :-
"Provided further that if a Bhumiswami of a land, which is reserved for a purpose other than agriculture in the development plan but is used for agriculture, wishes to divert his land or any part thereof to the purpose-for which it is re erved in the development plan, or land or any part thereof which is assessed for agricultural purpose and situated in any area other than an area covered by development plan to the purpose of industry, a written information of his intention, given by Bhumiswami to the Competent Authority shall be sufficient and no permission is required for such diversion."
(2) Sub-section (6-a) of Section l 72 of the Principal Act shall be deleted. In Section 200 of the Principal Act, for the words "two hundred" the words "two thousand" shall be substituted.
In section 227 of the Principal Act, for the word 'twenty", the words "one thousand"
shall be substituted.
(!) For sub-section (2) of Section 234 of the Principal Act, the following shall be substituted, namely :-
"(2) A draft of the Nistar Patrak shall be published in the village and after ascertaining the wishes of the Gram Sabha, as prescribed, it shall be finalised by the Sub-Divisional Officer."
(2) For sub-section (3) of Section 234 of the Principal Act, the following shall be substituted, namely :-
"(3) A copy of the Nistar Patrak so finalised shall be kept in the office of the Gram Panchayat."
(3) After sub-section (3) of Section 234 of the Principal Act, the following shall be added, namely :-
(l)
"(4) On a resolution passed by the Gram Sabha by a majority of not less than two third of members present and voting, the Sub-Divisional Officer with the prior sanction of the Collector and after making such enquiry, may amend the Nistar Patrak."
In Section 257 of the Principal Act, clause (a) shall be read as clause (a~ l).
(2) In Section 257 of the Principal Act, before clause (a-1), the following new clause shall be inserted, namely :-
"(a) any decision regarding any right under sub-section (1) of Section 57 between the State Government and any person".

( I) This Act may be called rhe Chhanisgarh Land Revenue (Amendment) Act,2015.
(2) It shall come into force from the date of its publ ication in rhe Ofticial Gazette. After clause (o-a) of sub-section (I) of Section 2 of the Chhartisgarh Land Revenue Code. 1959 (No. 20 of 1959), (hereinafter referred to as the Principal /\ct). the following shall be in erted. namely:-

THE CHHATIISGARH LAND REVENUE CODE (AMENDMENT) ACT, 2016
An Act further to amend the Chhattisgarh Land Revenue Code, 1959 (No. 20 of 1959).
Be it enacted by the Chhattisgarh Legislature in the Sixty-seventh Year of the Republic of India, as follows:-

(I) This Act may be called the Chhattisgarh Land Revenue Code (Amendment) Act, 2016.
(2) It shall come into force from the date of its publication in the Official Gazette.
In Section 237 of the Chhattisgarh Land Revenue Code, 1959 (No. 20 of 1959), -
(a) after sub-section (3), the following shall be inserted, namely:-
"(3-a) Where the land kept for the purposes mentioned under clause (b) of sub-section (I) is found within the area identified for any industrial, commercial or mining project, then the collector may divert such land for the above mentioned purposes, but such diversion can be made only when equivalent land is provided for the purpose of clause (b) of sub-section (I) within the same village."
(b) in sub-section ( 4), after the words "alternative land of equivalent area", the words "in the same village" shall be inserted.
