(Bihar Act 15, 2019) The Bihar Technical Service Commission (amendment) Act, 2019
AN
ACT
to amend the BiharTechnical Service Commission Act, 2014 (Bihar Act 13, 2014) (as amended time to time) preamble :-
WHEREAS, According to section-13(1) of "Bihar Technical Service Commission Act, 2014", The Secretary of the Commission shall have the powers to exercise the powers similar to the head of the Departments of the State Government, in cases of the Administrative and Financial matters;
AND WHEREAS, Financial Powers of the Commission is being invested in Chairman of the Commission and in the Commission in Rule-10 (1) of "Bihar Technical Service Commission Rules, 2015"; AND WHEREAS, There is no any provision of Administrative and Financial power for Secretary of the Commission in Rule 10 (1) of the above said Rules, so there is a situation of contradiction in the above said Provisions in Act and Rules ;
AND WHEREAS, for smooth conducting of Bihar Technical Service Commission, suitable determination of Administrative and Financial Powers of the Commission is appropriate and amendment in aforesaid Act is required for this ;
NOW THEREFORE, be it enacted by the Legislature of the State of Bihar in the Seventieth year of the Republic of India as follows:-
1. Short title, extent and commencement.—
(i) This Act may be called "The Bihar Technical Service Commission (amendment) Act, 2019".
(ii) It shall extend to the whole of the State of Bihar
(iii) It shall come in to force from the date of its publication in the official gazette.
2. Amendment in Section-13(1) of Bihar Act 13, 2014 (As amended time to time) .—
Subsection (1) of section-13 of said Act, 2014 shall be Substituted by the following :-
"(1) For conduct of functions, administrative and financial powers of the Commission shall be same as are provided by the Rules made under this Act by the State Government."
