Section 1. Short title and commencement.

(1) This Act may be called the Jammu and Kashmir Ministers’ 2[and Ministers of State] Salaries Act, 1956.

3(2) It shall come into force on such date as the Government may, by notification in the *[Government Gazette], appoint in this behalf.

Section 2. Definitions.

In this Act––

(a) “house” includes the staff quarters and other buildings appurtenant thereto ;
(b) “maintenance in relation to a house shall include the payment of local rates and taxes and charges for electricity and water.


Section 3. Salaries and allowances of Ministers and Ministers of State.

1[(1) There shall be paid to the Chief Minister, each Minister and each Minister of State

(a) a salary of 2[seventy thousand rupees], 3[sixty-five thousand rupees] and 4[sixty thousand rupees] per mensem respectively, exclusively 5[x x x x] ; and
(b) an allowance of 6[one thousand rupees] per mensem to cover the cost of petrol or diesel oil for journey within a radius of sixteen kilometres from the headquarters.

(2) Each Minister 8[and each Minister of State] shall be provided with free furnished house, the maintenance charges of which shall be borne by the 9[Government of the Union territory of Jammu and Kashmir]. The 9[Government of the Union territory of Jammu and Kashmir] may also allow him to continue in free occupation of the house provided to him for a period not exceeding fifteen days from the date of his ceasing to be a Minister 10[or Minister of State, as the case may be].
(3) Each Minister 11[ and each Minister of State] shall be entitled to the use of a State car, the expenses on the maintenance and propulsion of which shall be borne by the 12[State Government] :
13[Provided that if a Minister or a Minister of State uses own car, he shall in that case be entitled to such additional allowances as may be prescribed under the rules made by the 14[Lieutenant Governor of the Union territory of Jammu and Kashmir].]

Section 3-A.Advances for motor cars.

10[3-A. Advance for motor cars.––There may be paid to any Minister or a Minister of State by way of a repayable advance such sum of money as may be determined by rules made in this behalf by the 9[Lieutenant Governor of the Union territory of Jammu and Kashmir] for the purchase of a motor car in order that he may be able to discharge conveniently and efficiently the duties of his office.

Section 3-B.Sumptuary and constituency allowance to Ministers and Ministers of State.

1[Sumptuary and constituency allowances] to Ministers and Ministers of State.––The 2[Lieutenant Governor of the Union territory of Jammu and Kashmir may, by rules made in this behalf, provide for the grant of such 1[sumptuary and constituency allowance] per mensum as he may deem fit to any Minister or a Minister of State.]

Section 4.Power to make rules.

(1) The Travelling Allowances including daily allowance of the Ministers 2[and Minister of State] as well as their rights in respect of leave and leave allowance shall be regulated in accordance with such rules as may be framed by the 3[Governor of the Union territory of Jammu and Kashmir] from time to time.

(2) The 3[Governor of the Union territory of Jammu and Kashmir] may pass such orders as he may deem necessary both in connection with the interpretation of the provisions of this Act and any Travelling Allowance claims of the Ministers prior to the commencement of this Act.
