झारखड रा:य मD लEटF और एHकेलेटरF तथा उनसे सबंK सभी मशीनरM और उपकरणF के 6नमा@ण, अ1धNठापन, रखरखाव तथा 6नरापद काय@ णालM को 4व6नयमत करने के लए एक अ1ध6नयम । यह भारत-गणरा:य के सस@Pवे वष@ मD झारखड रा:य 4वधानमडंल वारा अ1ध6नयमत हो:-
1. स)ं*+त नाम, व!तार एव ं-ारंभ
1) यह अ1ध6नयम झारखड लEट एव ंएHकेलेटर अ1ध6नयम, 2017 कहलायेगा।

2) इसका 4वHतार सपंणू@ झारखड रा:य मD होगा।
3) यह सरकार वारा राजपS मD 6नग@त अ1धसचूना मD यथा 6नयत तारMख से वतृ होगा।
2. प/रभाषाएँ:- जब तक सदंभ@ मD अUयथा अपेVWत नहM ंहो, तब तक इस अ1ध6नयम मD:-
क) "Hवचालत बचाव णालM" से अभ ेत है, ऐसी णालM िजसमD य)द भवन मD YबजलM चलM जाती है तो लEट अपने 6नकटतम सतह पर Zक कर खुल जायेगा;
ख) "एHकेलेटर" से अभ ेत है सवा[रयF को ऊपर या नीच ेले जाने या ले आने के लए YबजलM पर 6नरंतर चलने वालM सीढ़M;
ग) "सरकार" से अभ ेत है झारखड रा:य सरकार;
घ) "6नरMWक" से अभ ेत है 4वयतु अ1ध6नयम,2003 (केU`Mय अ1ध6नयम 36,2003) क= धारा-162 क= उपधारा-
(1) के अधीन रा:य सरकार वारा 6नयaुत वह 4वयतु 6नरMWक, िजसक= अ1धका[रता मD वह लEट या एHकेलेटर अ1धNठापन Hथल आता है;
ड0) "लEट" से अभ ेत है, YबजलM से चलने वालM ऊपर या नीचे ले जाने या ले आने के लए 4पजंरानमुा यSं णालM, वाHतव मD िजसका उपयोग सवारM या माल या दFनF को ढोने के लए Bकया जाता है; च) "लEट 4पजंरा" से अभ ेत है लEट का कार या 4पजंरा िजसका उपयोग सवारM या माल या दोनF के प[रवहन के लए Bकया जाता है;
छ) "लEट अ1धNठापन" मD शामल है लEट 4पजंरा, लEट माग@, लEट माग@ का घेरा एव ंलEट प[रचालन क= यांYSक णालM तथा र:जु, केबल, तार, सरुWा उपबधं तथा लEट प[रचालन से सबं1ंधत यSं एव ंमशीनरM; ज) "लEट माग@" से अभ ेत है, धूरा या ह4वश िजसमD लEट 4पजंरा आता जाता है; झ) "लEट माग@ घेरा" मD शामल है लEट माग@ के चारF ओर या बदं करने के लए वाHत4वक सरंचना; ञ) "मालक" से अभ ेत हf सोसाईटM या सगंम या सपंणू@ प[रसर या उसके Bकसी भाग के मालक या अ1धभोगी या अभधारM िजसने 6नबधंन के लए आवेदन Bकया है;
ट) "सवारM" से अभ ेत है, कोई gयिaत जो अपने प[रवहन के योजनाथ@ लEट या एHकेलेटर का उपयोग करता है;
HपNटMकरण:- इस खड के योजनाथ@ लEट चालक भी सवारM माना जायेगा।
ठ) "YबजलM" मD 4वयतु, जल 4वयतु, पवन 4वयतु या यांYSक= 4वयतु आ)द अथवा इनका कोई सयंोजन शामल है;

ड) "प[रसर" से अभ ेत है, कोई सरंचना चाहे वह Hथायी हो अथवा अHथायी और जहाँ लEट या एHकेलेटर अ1धNठा4पत Bकया गया है;
ढ़) "4व)हत" से अभ ेत है, इस अ1ध6नयम के अधीन बनाये गये 6नयमF वारा 4व)हत; ण) "6नबधंन" से अभ ेत है, इस अ1ध6नयम क= धारा-4 के अधीन 6नरMWक वारा लEट या एHकेलेटर क= स!ंया 6नयत करना;
त) "धारा" से अभ ेत है, इस अ1ध6नयम क= धारा;
थ) "रा:य" से अभ ेत है, झारखड रा:य ;
3. पदाधका/रय4 और पदधा/रय4 क5 $नयिु8त:-
1) सरकार वारा सhपे गये कृiयF के 6नNपादनाथ@ या इस अ1ध6नयम के अधीन राजपS मD अ1धसचूना वारा एक म!ुय 4वयतु 6नरMWक और यथा आवjयक 6नरMWकF, अUय पदा1धका[रयF एव ंपदधा[रयF क= 6नयिुaत करेगी, जो यथा 4व)हत अह@ता रखत ेहF;
2) म!ुय 4वयतु 6नरMWक रा:य के 6नरMWकF और अUय पदा1धका[रयF एव ंपदधा[रयF पर आम अ1धWण एव ं 6नयSंण रखेगा और इस अ1ध6नयम के योजनF को परूा करने के लए आवjयक 6नदेश 6नग@त करेगा;
4. $नबधंन
1) लEट या एHकेलेटर के अ1धNठापन के पjचात उसका मालक एक माह के भीतर ऐसी लEट या एHकेलेटर के 6नबधंन हेत ुयथा 4व)हत शkुक के साथ 4व)हत फारम मD आवेदन करेगा। शkुक अ 6तदेय होगा;
2) सभी तरह से पणू@ आवेदन ाmत होने पर 6नरMWक 30 )दनF के भीतर लEट या एHकेलेटर क= स!ंया नीयत करत ेहुए इUहD 6नब1ंधत करेगा;
3) लEट या एHकेलेटर का iयेक मालक लEट या एHकेलेटर के 6नबा@ध एव ं 6नरापद सचंालन हेत ु Bकसी लEट या एHकेलेटर रख-रखाव क+पनी वारा क= गई स4ंवदा या gयgHथा को माण HवZप देत ेहुए लEट या एHकेलेटर के वा4ष@क रख-रखाव क= स4ंवदा या क= गई कोई अUय gयवHथा क= 6त iयेक वष@ 6नरMWक को देगा।
4) लEट या एHकेलेटर का iयेक मालक लEट या एHकेलेटर के 6नबा@ध एव ं6नरापद सचंालन के लए यथा 4व)हत फारम मD एव ंरM6त से सभी वा4ष@क सरुWा माण पS देगा;
5. !वचा लत बचाव -णाल<:-
YबजलM चलM जाने क= दशा मD लEट मD फंसे सवा[रयF को बचाने हेत ुउसका मालक Hवचालत बचाव णालM क= gयवHथा करेगा, िजसमD लEट अपने 6नकटतम सतह पर आकर Zकेगा तथा उसका दरवाजा खलु जायेगा।

6. वकैि>पक ?बजल< आप$ूत B -णाल<:-
YबजलM चलM जाने क= दशा मD लEट का काय@ करना स6ुनिjचत करने के लए मालक 30 सेकD ड के भीतर वकैिkपक Hवचालत YबजलM आप6ूत @ णालM क= gयवHथा करेगा।
7. $नर<*ण:-
6नरMWक या सरकार वारा ा1धकृत Bकसी पदा1धकारM या अभकरण वारा 6नब1ंधत iयेक लEट या एHकेलेटर का 6नरMWण तीन वषn मD एक बार Bकया जायेगा। ऐसे 6नरMWण के लए Bकसी अUय 4वयतु अ1धNठापन जाँच शkुक के अ6त[रaत 4व)हत शkुक लया जायेगा।
8. Cयवहार सEंहता:-
1) इस अ1ध6नयम मD अUयथा उपब1ंधत के सवाय इस अ1ध6नयम के यजनF को परूा करने के लए भारतीय मानक oयरूो क= ससुगंत gयवहार स)ंहता, य)द कोई हो का पालन Bकया जायेगा, (िजसमD राNpMय भवन स)ंहता और राNpMय 4वयतु स)ंहता भी शामल है) तथा कोई असगं6त पायी जाने क= दशा मD इस अ1ध6नयम या एतदधीन बनाये गये 6नयमF के उपबधं अभभावी होगा;
2) यaुत साम ी एव ंउपकरण सबं1ंधत भारतीय मानक oयरूो के 4व6नदqश से सपंNूट हFगे, जहाँ ऐसे 4व6नदqश पहले हM अ1धक1थत हf;
3) प[रसरF मD अ1धNठा4पत Bकये जाने वाले लEटF या एHकेलेटरF क= स!ंया और उनके बीच क= परHपर दरूM भारतीय मानक oयरूो एव ंराNpMय भवन स)ंहता क= ससुगंत gयवहार स)ंहता से शासत हFगे;
9. वFयमान ल ट4 या ए!केलेटर4 का $नबधंन:-
1) धारा-4 मD अUत4व@Nट Bकसी बात के होत ेहुए भी ऐसा iयेक मालक िजसने इस अ1ध6नयम के ारंभ होने क= ता[रख से पवु@ प[रसरF मD लEट या एHकेलेटर का अ1धNठापन Bकया है वह इसके भावी होने के दो माह क= अव1ध के भीतर ऐसे लEट या एHकेलेटर के 6नबधंन के लए आवेदन करेगा;
2) ऐसे आवेदन पर धारा-4 क= उपधारा-(2), (3) एव ं(4) के उपबधं लाग ूहFगे;
10. $नर<*ण के लए Gकसी भवन मH -वेश करने का अधकार:-
कोई 6नरMWक सभी उपयaुत समय मD सरकारM सेवा मD रहने वाले Bकसी सहायक, य)द कोई हो, के साथ जैसा वह उ1चत समझ,े Bकसी ऐसे प[रसर मD िजसमD लEट या एHकेलेटर अ1धNठा4पत Bकये गये हf अथवा िजनके 6नबधंन के लए आवेदन ाmत हुए हf लEट या एHकेलेटर या उनके अ1धNठापन या उनके काय@Hथल के 6नरMWण के लए वेश कर सकत ेहै।
11. असरु)*त अव!था वाले ल ट या ए!केलेटर:-

धारा-7 के अधीन 6नरMWण करने के उपरांत य)द 6नरMWक यह पाता है Bक Bकसी भवन का कोई लEट या एHकेलेटर असरुVWत अवHथा मD है, तो वह ऐसे मालक को 4व6न)द@Nट समय के भीतर ऐसे लEटF या एHकेलेटरF क= यथा आवjयक मर+मत या प[रवत@न कराने का 6नदेश दे सकता है अथवा वह उसका उपयोग तब तक रोक सकता है, जबतक Bक उसका समाधान न हो जाय Bक ऐसी मर+मत या प[रवत@न करा लये गये हf या असरुVWत अवHथा दरू कर लM गई है।
12. सील करना:-
1) कोई लEट या एHकेलेटर िजसके सबंधं मD धारा-11 के अधीन कोई 6नदqश 6नग@त Bकया गया है, उसका 6नरMWक के समाधान होने तक पालन नहMं Bकया गया है, ऐसे लEट या एHकेलेटर को य)द उसी अवHथा मD चलता हुआ पाया जाता है, तो 6नरMWक वारा उसे सील करने का आदेश )दया जा सकता है;
2) उपधारा-(1) के अधीन Bकये गये आदेश के 4वZK कोई अपील म!ुय 4वयतु 6नरMWक, ऊजा@ 4वभाग, झारखड के पास क= जायेगी और उनका 6नण@य अ6ंतम होगा;
13. बीमा:-
ऐसे लEट या एHकेलेटर का अ1धNठापन परूा होने के पjचात मालक को ततृीय पW बीमा स6ुनिjचत करना बाrयकारM होगा ताBक उसका उपयोग करने वाले सवा[रयF का जो7खम आsछा)दत हो सके।
14. कमBप!ुती और -$तवेदन:-
1) मालक iयेक लEट या एHकेलेटर के लए कम@पHुती सधंा[रत करेगा तथा उसमD प[रचालन ठप हो जाना (4वयतु आप6ूत @ चलM जाने से भUन) और दघु@टना, य)द कोई हो, तो दज@ करेगा। इस कम@पHुती का 6नरMWण 6नरMWक वारा जब और जसेै चाहD Bकया जा सकता है;
2) जब कभी Bकसी ऐसे लEट या एHकेलेटर के प[रचालन पK6त मD कोई दघु@टना के कारण Bकसी gयिaत को W6त होती है, तो मालक 24 घटें के भीतर दघु@टना का परूा oयौरा ऐसे लEट या एHकेलेटर के लए काय@ करने वाले 6नरMWक को यथा 4व)हत फारम मD देगा और 6नरMWक क= ल7खत अनमु6त के Yबना इसे पनुः चाल ुनहMं करेगा;
15. समवतK दा$यLव:-
ऐसे लEट या एHकेलेटर के Bकसी सरुWा उपबधं के ठvक से काय@ नहMं करने के चलत ेदघु@टना होने क= दशा मD यथािHथ6त, लEट या एHकेलेटर अ1धNठापन या रख-रखाव क+पनी पर भी अभयोजन चलाया जा सकता है तथा उसे इस अ1ध6नयम के अधीन दड का भागी ठहराया जा सकता है।
16. बदं होने क5 सचूना देना:-
य)द Bकसी भवन मD जहा ँलEट या एHकेलेटर अ1धNठा4पत Bकये गये हf, वह काय@ नहMं करता है तो मालक वारा इसक= सचूना एक माह क= अव1ध के भीतर 6नरMWक को दM जायेगी।

17. जीवन व!तार:-
प[रसरF मD अ1धNठा4पत लEट या एHकेलेटर को उसके अ1धNठापन के बीस वषn क= अव1ध के पjचात मालक वारा बदल )दया जायेगा। ऐसा बदलाव लEट या एHकेलेटर के अ1धNठापन के 21वD वष@ मD परूा कर लया जायेगा तथा मालक धारा-4 के अधीन नया 6नबधंन के लए आवेदन करेगा।
18. शथल करने क5 शि8त:-
सरकार ल7खत आदेश वारा इस अ1ध6नयम या एतदधीन बनाये गये 6नयमF के Bकसी उपबधं को ऐसी शत@ के अrयधीन, जो वह उ1चत समझे श1थल कर सकती है।
19. शि8तय4 का -Lयायोजन:-
सरकार इस अ1ध6नयम वारा या इसके अधीन दत शिaतयF को Bकसी ऐसे पदा1धकारM को iयायोिजत कर सकती है, िजसे वह उ1चत समझे।
20. शाि!त:-
जो कोई इस अ1ध6नयम या एतदधीन बनाये गये 6नयमF के Bकसी उपबधं का उkलघंन करता है, तो वह दोष स4K होने पर तीन माह तक का कारावास या पचास हजार Zपये तक का जुमा@ना या दोनF से दडनीय होगा तथा लगातार उkलघंन करने पर थम बार ऐसे उkलघंन के लए दोष स4K के पjचात जारM उkलघंन के दौरान 6त)दन एक हजार Zपये तक का अ6त[रaत जुमा@ना लगेगा।
21. अपराध का सNंान:-
इस अ1ध6नयम के अधीन 6नयaुत 6नरMWक वारा Bकये गये प[रवाद के अलावे कोई भी Uयायालय इस अ1ध6नयम के अधीन Bकसी अपराध का सwंान नहMं लेगा।
22. सOावपवूBक क5 गई कारBवाई का सरं*ण:-
इस अ1ध6नयम या एतKान बनाये गये 6नयमF के उपबधंF के अनपुालन मD सxावपवू@क क= गई या Bकये जाने से
आश6यत Bकसी बात के लए Bकसी gयिaत के 4वZK कोई वाद, अभयोजन या अUय 4व1धक काय@वाहM नहMं चलाई जायDगी।
23. $नयम बनाने क5 शि8त:-
1) सरकार इस अ1ध6नयम के योजनाथ@ राजपS मD अ1धसचूना वारा 6नयम बना सकती है;
2) 4वशNटतया और पवू@गामी शिaत क= gयापकता पर 6तकूल भाव डाले Yबना ऐसे 6नयमF मD 6न+नल7खत सभी या Bकसी बात का उपबधं Bकया जा सकता है:-

क) लEटF या एHकेलेटरF के लए 4व6नदqश; ख) रM6त, िजसमD लEट या एHकेलेटर क= प[र6नमा@ण योजना Hततु क= जाती है; ग) रM6त, लEटF या एHकेलेटरF क= जाँच क= जाती है; घ) लEट या एHकेलेटर के प[र6नमा@ण हेत ुअनमु6त का आवेदन पS तथा ऐसे लEट या एHकेलेटर का काय@ करने के लए अनwुिmत;
ड‐) धारा-1 क= उपधारा-(4) के अधीन भेजे जाने वाले समापन 6तवेदन का फारम; च) शतy एव ंबधेंज और 6नबzधन और फारम िजनके अrयधीन लEटF या एHकेलेटरF क= अनwुिmत मजंूर क= जाती है तथा ऐसी अनwुिmत के लए भगुतान Bकये जाने वाले शkुक; छ) रM6त और बधेंज िजनके अrयधीन लEट या एHकेलेटर काय@ करDगे; ज) रM6त, िजसमD धारा-14(2) के अधीन दघु@टना क= सचूना दM जायेगी; झ) अपील करने का फारम एव ंरM6त; और
ञ) कोई अUय मामला जो 4व)हत Bकया जानेवाला हो या 4व)हत Bकया जा सके;
3) इस अ1ध6नयम के अधीन बनाया गया iयेक 6नयम बनाये जाने के तरंुत बाद रा:य 4वधानमडंल के समW रखा जायेगा, जब वह सS मD हो, य)द सदन सहमत हो जाता है Bक 6नयम मD उपांतरण Bकया जाय अथवा 6नयम बनाया हM नहMं जाय, तो 6नयम यथािHथ6त, उपांत[रत Zप मD भावी होगा या अ भावी होगा तथा4प ऐसा उपांतरण या बा6तलMकरण उस 6नयम के अधीन पवू@ मD क= गई Bकसी बात क= 4व1धमाUयता पर 6तकूल भाव डाले Yबना होगा।
24. Cयाव$ृत:-
इस अ1ध6नयम मD अUत4व@Nट कोई बात 4वयतु अ1ध6नयम, 2003 (2003 का 36) या एतKीन बनाये गये 6नयमF के उपबधंF पर भावी नहMं होगी ।

The Jharkhand Lift And Escalators Act, 2017 (Jharkhand Act No. 18, 2017)
An Act to provide for the regulation of the construction, installation, maintenance and safe working of lifts and escalators and all machinery and apparatus pertaining thereto in the State of Jharkhand. Be it enacted by the Legislature of the State of Jharkhand in the Sixty Seventh year of the Republic of India as follows :-
Short title, extent and commencement
1 (1) This Act may be called as The Jharkhand Lift and Escalators Act, 2017.
(2) It extends to the whole State of Jharkhand.
(3) It shall come into force on such date, as the Government may, by notification in the Official Gazette.
Definitions. 2 In this Act unless the context otherwise required,-
(a) "automatic rescue device" means a device which, in case of power failure in the building, enables the lift to land and stop at the nearest landing floor and open the landing and lift cage doors simultaneously;
(b) "escalator" means a moving inclined continuous stairway or runway used for raising or lowering passengers, which work on power;
(c) "Government" means the Government of the State of Jharkhand;
(d) "Inspector" means the Electrical Inspector appointed by State Government under Sub Section (1) of Section 162 of the Electricity Act, 2003 (Central Act 36 of 2003), who has Territorial Jurisdiction over the place of installation of a lift or an escalator;
(e) "lift" means a hoisting and lowering mechanism equipped with a cage which moves in an upward and downward direction, and work on power and is designed or is actually used to carry passengers or goods, or both;
(f) "lift cage" means a car or a cage of a lift used for the conveyance of passengers or goods, or both;
(g) "lift installation" includes a lift cage, a lift way, a lift way enclosure, and an operating mechanism of the lift and ropes, cables, wires, safety provisions and plant and machinery connected with the operation of the lift;
(h) " lift way" means a shaft or hoist way in which the lift cage travels;
(i) "lift way enclosure" includes any substantial structure surrounding or enclosing the lift way;
(j) "owner" means an owner or occupier or office bearer of a society or an

association, or a tenant, of the whole or part of a premises, who has applied for registration;
(k) "passenger" means any person who uses the lift or escalator for the purpose of his conveyance;
Explanation.- For the purpose of this clause, a lift operator shall also be treated as a passenger;
(l) "power" includes electrical, hydraulic, pneumatic or mechanical power, etc. or a combination of any of these;
(m) "premises" means any structure, whether temporary or permanent, where a lift or escalator is installed;
(n) "prescribed" means prescribed by rules made under this Act;
(o) "registration" means assignment of a number to a lift or escalator by the Inspector under section 4 of this Act.
(p) "section" means a section of this Act;
(q) "State" means the State of Jharkhand.
Appointment of officers and officials.
3 (1) The Government shall, by notification in the Official Gazette, appoint a Chief Electrical Inspector and as many Inspectors other officers and officials, as may be necessary, having such qualifications as may be prescribed, for the purpose of performing the functions assigned to them by or under this Act.
(2) The Chief Electrical Inspector shall have general superintendence and control over the Inspectors and other officers and officials in the State and may issue necessary directions for carrying out the purpose of this Act.
Registration. 4 (1) Every owner shall, within a period of one month after the completion of the installation of a lift or an escalator, apply for registration for such lift or escalator, in such form and manner along with such fee as may be prescribed. The fee shall be non-refundable.
(2) On receipt of an application, complete in all respects, the Inspector shall register the lift or escalator, by assigning a number to it within a period of thirty days.
(3) Every owner of a lift or escalator, shall submit every year a copy of annual lift or escalator maintenance contract or any other arrangement made for maintenance of lifts and escalators to the Inspector in token of having the contract or arrangement made with any lift or escalator maintenance company for the smooth and safe running of the lift or escalator.
(4) Every owner of a lift or escalator shall also furnish all annual safety certificates in such form and manner as may be prescribed for the smooth and safe running of the lift or escalator.
Automatic rescue device.
5 The owner shall make arrangement to provide for an automatic rescue device to rescue the travelling passengers trapped in the lift in the event of breakdown of power supply by bringing and stopping the lift at the nearest landing floor and keeping the landing and lift cage door open.
Alternate power supply system.
6 The owner shall make arrangements to provide for alternative automatic power supply system to ensure the functioning of the lift in the event of breakdown of power supply within a period of thirty seconds.
Inspection. 7 Every lift and escalator which has been registered shall be inspected once in a period of three years by the Inspector or by an officer or an agency

झारखड गजट (असाधारण) सोमवार, 4 )दस+बर, 2017 authorized by the Government on its behalf. A fee as may be prescribed shall be charged for such inspection, in addition to any other electrical installation testing fees.
Code of practice. 8 (1) Save as otherwise provided in this Act, the relevant code of practice of the Bureau of Indian Standards (including National Building Code and National Electrical Code), if any, may be followed to carry out the purposes of this Act and in the event of any inconsistency, the
provisions of this Act and the rules made there under shall prevail.
(2) The material and apparatus used shall confirm to the relevant specifications of the Bureau of Indian Standards where such specifications have already been laid down.
(3) The number of lifts or escalators to be installed in a premises and the spacing between them shall be governed as per the relevant code of practice of Bureau of Indian Standards and the National Building Code.
Registration of existing lifts and escalators.
9 (1) Notwithstanding anything contained in section 4, every owner who has installed a lift or an escalator in premises before the date of the commencement of the Act, shall within a period of two months from such commencement, apply for a registration of such lift or escalator.
(2) The provisions of sub-sections (2), (3) and (4) of section 4 shall, apply to such application.
Right to enter any building for inspection.
10 An inspector at all reasonable hours, with such assistants, if any, being persons in the service of the Government, as he thinks fit, may enter any premises in which a lift or an escalator is installed or in connection with which an application for registration has been received, for the purpose of inspection the lift or escalator or their installation or the site thereof.
Lifts or escalators in an unsafe
condition.
11 If, upon an inspection as it is carried out under section 7, the Inspector finds that any lift or escalator in any building is in an unsafe condition, he may direct the owner requiring such repairs or alterations to be made to such lift or escalators, as he may deem necessary, within the period specified by him and may also forbid the use of such lift or escalator until such repairs or alterations are carried out or such unsafe condition is removed to his satisfaction.
Sealing. 12. (1) Any lift or escalator in respect of which a direction is issued under section 11 has not been carried out to the satisfaction of the Inspector, such lift or escalator, in case the same is found being used may be ordered to be sealed by the Inspector.
(2) An appeal against an order under sub-section (1) shall lie to the Chief Electrical Inspector, Energy Department, Jharkhand, whose decision shall be final.
Insurance. 13 The owner shall, after the completion of the installation of such lift or escalator, ensure third party insurance mandatory so as to cover the risk of passengers using such lift or escalators.
Log book and reporting.
14 (1) The owner shall, maintain a log book for each lift and escalator and enter therein the details of operation, break-down (other than failure in electrical supply) and accident, if any. This log book may be inspected by the Inspector as and when he desires.
(2) Whenever any accident occurs in the process of operation of any lift or

escalator causing injury to any person, the owner shall, within a period of twenty-four hours of the accident, give intimation with full details of accident, in such form as may be prescribed, to the Inspector the working of such lift or escalator, shall not be resumed except, with the written permission of the Inspector.
Concurrent liability.
15 The lift or escalator installation or maintenance company, as the case may be, may also be prosecuted and held liable for punishment under this Act in case an accident occurs in the lift or escalator, due to malfunctioning of any of the safety provisions of the lift or escalator, if attributable to such lift or escalator installation or maintenance company.
Intimation about closure.
16 If any building where lift or escalator is installed gets decommissioned, intimation about this shall be given by the owner to the Inspector within a period of one month.
Life span. 17 A lift or escalator installed in the premises shall be replaced by the owner of the lift or escalator, after the period of twenty years of its installation. Such replacement shall be completed within the twenty-first year of the installation of the lift or escalator, and the owner shall apply for a fresh registration under section 4.
Power to relax. 18 The Government may, by order in writing, direct that any of the provisions of this Act or the rules made thereunder shall be relaxed subject to such conditions as it may be fit.
Delegation of powers.
19 The Government may, delegate any of its powers conferred on it by or under this Act, to such officer as it may deem fit.
Penalty. 20 Whoever contravene any of the provisions of this Act, or the rules made thereunder shall, on conviction be punishable with imprisonment for a term which may extend to three months, or with fine which may extend to fifty thousand rupees, or both, and in the case of a continuing contravention with an additional fine which may extend to one thousand rupees for every day during which such contravention continues after conviction for the first such contravention.
Cognizance of offence.
21 No Court shall take cognizance of any offence under this Act except on complaint made by the Inspector, appointed under the Act.
Protection for action taken in good faith.
22 No suit, prosecution or other legal proceedings shall lie against any person in respect of anything which is done in good faith or intended to be done in pursuance of the provisions of this Act, or of the rules made thereunder.
Power to make rules.
23 (1) The Government may, by notification in the Gazette, make rules for the purpose of this Act.
(2) In particular and without prejudice to the generality of the foregoing power, such rules may provide for all or any of the following matters, namely :-
(a) Specifications for lifts and escalators;
(b) The manner in which erection plans of lift and escalators shall be submitted;

(c) The manner in which lifts and escalators may be tested;
(d) The form of application of permission for the erection of lift and escalators and license for working such lifts and escalators;
(e) The form of report of completion to be sent under sub-section (4) of section 1;
(f) The term and conditions and restrictions subject to which, and the form in which, the license may be granted for the working of lifts and escalators and the fees to be paid in respect of such licence;
(g) The manner in which and the terms subject to which the lifts and escalators shall be worked;
(h) The manner in which notice of accidents shall be given;
(i) The form of notice of accidents to be given under section 14 (2);
(j) The form and manner to file appeal; and
(k) Any other matter which is to be, or may be prescribed.
(3) Every rules made under this Act shall be laid, as soon as may be, after it is made, before the House of the State Legislature, while it is in session, if the House agrees in making any modification in the rule or the House agrees that the rule should not be made, the rule shall thereafter have effect only in such modified form, or be of no effect, as the case may be; so, however, that any such modification or annulment shall be without prejudice to the validity of anything previously done under that rule.
Savings. 24 Nothing contained in this Act shall affect the provisions of the Electricity Act, 2003 (36 of 2003) or the rules made thereunder.
