Government of Union Territories and the Government of National Capital Territory of Delhi (Amendment) Act, 20051

An Act further to amend the Government of Union Territories Act, 1963 and to amend the Government of National Capital Territory of Delhi Act, 1991

Be it enacted by Parliament in the Fifty-sixth Year of the Republic of India as follows:-

"4. Savings.- The repeal by this Act of any enactment shall not affect any Act in which such enactment has been applied, incorporated or referred to;

and this Act shall not affect the validity, invalidity, effect or consequences of anything already done or suffered, or any right, title, obligation or liability already acquired, accrued or incurred, or any remedy or proceeding in respect thereof, or any release or discharge of or from any debt, penalty, obligation, liability, claim or demand, or any indemnity already granted, or the proof of any past act or thing;

nor shall this Act affect any principle or rule of law, or established jurisdiction, form or course of pleading, practice or procedure, or existing usage, custom, privilege, restriction, exemption, office or appointment, notwithstanding that the same respectively may have been in any manner affirmed, recognised or derived by, in or from any enactment hereby repealed;

nor shall the repeal by this Act of any enactment provide or restore any jurisdiction, office, custom, liability, right, title, privilege, restriction, exemption, usage, practice, procedure or other matter or thing not now existing or in force."

Section 1. Short title

Chapter 1 - Preliminary

1. Short title.-This Act may be called the Government of Union Territories and the Government of National Capital Territory of Delhi (Amendment) Act, 2005.

Section 2. Amendment of Section 3

Chapter 2 - Amendments to the Government of Union Territories Act, 1963

2. Amendment of Section 3.-In Section 3 of the Government of Union Territories Act, 1963 (20 of 1963) (hereafter in this chapter referred to as the Union Territories Act), in sub-section (5), in the Explanation, in the proviso,-

(i) for the figures "2000", the figures "2026" shall be substituted;

(ii) for the figures "1971", the figures "2001" shall be substituted.

Section 3. Amendment of Section 38

3. Amendment of Section 38.-In Section 38 of the Union Territories Act, in clause (b), for the words and figures "the Delimitation Commission Act, 1962 (61 of 1962)", the words and figures "the Delimitation Act, 2002 (33 of 2002)" shall be substituted.

Section 4. Amendment of Section 43-E

4. Amendment of Section 43-E.-In Section 43-E of the Union Territories Act,-

(i) for the figures "2000", the figures "2026" shall be substituted;

(ii) for the figures "1971", the figures "2001" shall be substituted.

Section 5. Amendment of Section 3

Chapter 3 - Amendment to the Government of National Capital Territory of Delhi Act, 1991

5. Amendment of Section 3.-In Section 3 of the National Capital Territory of Delhi Act, 1991 (1 of 1992), in the Explanation, for the proviso, the following proviso shall be substituted, namely:-

"Provided that the reference in this Explanation to the last preceding census of which the relevant figures have been published shall, until the relevant figures for the first census taken after the year 2026 have been published, be construed as a reference to the 2001 census.".
