1. The Applicant filed an RTI application dt.2.7.10 with the PIO, Northern Railway HQ, New Delhi seeking information against 3 points with regard to the vigilance enquiry conducted against Shri Sudhir Kumar Tiwari. Shri Sanjay Kumar, PIO/Vigilance replied on 6.7.10 stating that investigation is still on going and denied the information u/s 8(1)(h) of the RTI Act. Not satisfied with the reply, the Applicant filed an appeal dt.22.8.10 with the Appellate Authority reiterating his request for the information. The Appellate Authority vide his order dt.24.9.10 upheld the decision of the PIO. Being aggrieved with the reply, the Applicant filed a second appeal dt.24.10.10 before CIC. Decision

During the hearing, the Respondents submitted that the investigation was completed on 13.9.10 and the vigilance branch had submitted the report to the concerned Disciplinary Authority for necessary action and that the final decision has yet to be taken by the DA based on the enquiry report. Hence information cannot be provided at this stage. The Respondent also clarified that the Applicant is the complainant on whose complaint the investigation was conducted by the Vigilance section.
