BIRD, V. C.
C. Haight, for Mrs. Laird.
W. T. Hoffman, for Mr. Laird.
BIRD, V. C. An application has been made by Mrs. Laird to change solicitors. This is resisted because she has not compensated her presentsolicitor, nor paid him for the fees and costs with which he is chargeable. I am asked to fix his compensation. This I decline to do. The case is in no condition for me to do that. That much of the controversy will be left for the future. I will advise an order that, upon Mrs. Laird paying to her present solicitor the fees and taxed costs with which her solicitor is chargeable, as such solicitor, and $100, the motion for the appointment of another solicitor be granted. I am satisfied that nothing more should be required of her now. I am satisfied that to require more would be equivalent to closing the door to any further prosecution of her defense; for she is now practically without the means to do so. This is doing no injustice to Gen. Haight. It leaves him just where he placed himself. He trusted his client, and the court does not propose to disturb that trust.
