(Syllabus.)
1. Jury — Defendant in Felony Case May Waive Right of Trial by Jury — Force and Effect of Court's Findings Same as That of Verdict. Under the provisions of section 20, article 7, of the State Constitution, Okla. St. Ann., a defendant in a felony case may waive the right of trial by jury, and be tried by the court. The findings of fact by the judge will have the same force and effect as a verdict by the jury.
2. Same — Appeal and Error — Court's Findings Acquitting Defendant of Second-Degree Forgery not Disturbed. Under Oklahoma Statutes 1931, section 2126, O.S.A. title 21, sec. 1578, where one is charged with the possession of a forged, altered or counterfeited negotiable note, bill or draft, etc., and waives a jury and is tried before the court and found not guilty, this court will not find that the court erred in its conclusion that under the evidence there was no knowledge of the forged instrument, and no evidence of an intent on the part of the defendant to utter and pass the same.
3. Evidence — Unsigned Statements and Statements of Accused Made in Jail Properly Excluded in Trial of Forgery Case to Court on Ground Statements Were Made Under Duress. Where defendant was tried by the court after having waived a jury trial, it was not error for the court to refuse admission in evidence of a statement dictated by officers, and unsigned by defendant. Nor did the court err in refusing to permit the officers to testify as to statements made by defendant, while under arrest and in jail, under the facts and circumstances in this case.
