(Syllabus.)
1. Arrest — Offense of Unlawful Possession of Liquor Was not Committed "in Presence of Officer" Who Went on Private Premises and Through Window Spied Bottle of Liquor on Table With no One Present. Under Oklahoma Statutes 1931, section 2780, O.S.A. (Stat. 1941), Title 22, § 196, an officer has the right to arrest a person who commits a misdemeanor in his presence without the necessity of a warrant. After such arrest he has the right to search the person of defendant and his immediate surroundings. Under the facts in this case he did not have such right.
2. Searches and Seizures — One in Possession but not Owner of Premises May Object to Legality of Search. The right of search and seizure is personal and where one does not own or have control or possession of property searched, he cannot raise the question of the legality of the search. But where one has the possession or control of said property, although he does not have the legal title thereto, he can raise the question as to the legality of the search of the property.
