WESTHUES, Commissioner.
Appellant Troy Clayton was convicted of burglary and larceny. His punishment was fixed by a jury at two years' imprisonment in the State Penitentiary for the burglary and a like punishment for the larceny. The trial judge commuted the punishment to four years' imprisonment in the Intermediate Reformatory for Boys at Algoa. An appeal was taken from the sentence.
We have only the record proper before us for review. Appellant did not file a transcript of the evidence in this court nor was a brief filed on appellant's behalf.
The information was filed on November 1, 1949, in the Circuit Court of Ozark County, Missouri. Appellant filed an application for a change of venue which the court sustained. The case was transferred to the Circuit Court of Christian County where a trial was had. On May 26, 1950, a jury returned a verdict finding appellant guilty. The verdict contains a separate finding as to burglary and to larceny, with a punishment of two years' imprisonment in the State Penitentiary for each offense.
The verdict is in proper form. We also find the information to be in proper form. The record shows that appellant was arraigned and entered a plea of not guilty; that a jury was impaneled and sworn to try the case; that a verdict was returned; that a motion for new trial filed later was overruled; and that appellant was awarded allocution and sentenced.
The record being free from error, the judgment is affirmed.
