Order entered on February 5, 1969, denying motion for a change of venue to Monroe County, unanimously reversed on the law, the facts and in the exercise of discretion, and the motion is granted, without costs and without disbursements. All of the relevant considerations indicate Monroe County, where the action arose, is the proper county for trial. The underlying action is one for malpractice against a physician, a resident of Monroe County, and a Monroe County Hospital. Indeed, all of the parties are residents of Monroe County except the divisions of American Home Products Corporation named as defendants, and for this group a vice-president of the Ayerst Laboratories joins in the request. And the opposing affidavit lists 10 physicians as likely witnesses, all residents of Monroe County. Moreover, a more speedy trial is available in that county. Thus, the convenience of witnesses and the ends of justice will be promoted by a granting of the motion. ( Padilla v. Greyhound Lines, 29 A.D.2d 495.) Order entered November 14, 1969, granting plaintiff's motion to continue the examinations before trial, unanimously modified on the law and the facts, and in the exercise of discretion, without costs and without disbursements, to the extent of providing that the examinations be conducted in Monroe County at a time and place to be agreed upon or as directed by the Special Term of that county. It having been directed that the main action be tried in Monroe County, it is fitting the examinations proceed there under the supervision, if need be, of the Supreme Court, Special Term, of that county.
