RUSSELL LEACH, Judge.
On October 23, 1987, the single commissioner issued an opinion and order which denied the applicant's claim pursuant to R.C. 2743.60(D) since all allowable expense had been recouped from collateral sources. On March 21, 1988, the applicant, Glenn A. Stewart, Jr., filed an objection and notice of appeal from the single commissioner's decision. On May 24, 1988, the panel issued an order which dismissed the applicant's objection, stating that it was untimely filed, pursuant to R.C. 2743.55(C). The applicant subsequently filed a notice of appeal.
This cause came before the court pursuant to R.C. 2743.61, and was heard by the court upon argument of the applicant and an Assistant Attorney General.
Upon review, the court finds that the record does not show that the applicant received timely notice of the decision of the single commissioner. In view of the lack of adequate notice of the decision, the court does not agree with the finding of the panel that the applicable objection was not timely filed. The court agrees, however, with the panel that the order does not prejudice the applicant's right to file a supplemental application, pursuant to R.C. 2743.68, if he incurs economic loss not considered in the single commissioner's determination. The court further finds that the single commissioner correctly determined that applicant's allowable expenses have been reimbursed from collateral sources. Under the present circumstances, the court sets aside the panel's finding that the objection was untimely filed; however, the court shall not remand this claim since there is no economic loss to consider at this point in time. The applicant may file a supplemental reparations application in the future when he incurs any unreimbursed economic loss; this entry shall not prejudice a filing concerning past economic loss if any is unreimbursed.
Accordingly, the applicant's claim is denied.
Claim denied.
