LEE YEAKEL, District Judge
On this date the Court denied Plaintiff's Motion for Partial Summary Judgment (Clerk's Doc. No. 15), Defendants' Motion for Partial Summary Judgment (Clerk's Doc. No. 23), and Plaintiff's Motion for Summary Judgment (Clerk's Doc. No. 43) and granted in part Defendants' Cross Motion for Summary Judgment (Clerk's Doc. No. 42). The Court therefore enters the following Final Judgment pursuant to Federal Rule of Civil Procedure 58.
IT IS HEREBY ORDERED that Defendant Gale Norton, Secretary of the Interior, and the United States Fish and Wildlife Service shall issue a "12-month" finding, regarding cicurina cueva, on or before December 8, 2005. See 16 U.S.C. § 1533(b)(3)(B). In all other respects, it is ORDERED that Plaintiff, Save Our Springs Alliance, TAKE NOTHING by its action against Defendants.
IT IS FURTHER ORDERED that all costs of court are taxed against the party incurring the same.
IT IS FURTHER ORDERED that all relief not expressly granted is hereby DENIED.
IT IS FINALLY ORDERED that the case hereby
CLOSED.
