ORDER SUSTAINING OBJECTION TO CLAIM #24 OF ECAST SETTLEMENT CORPORATION

DALE L. SOMERS, Bankruptcy Judge

UPON the Objection to Claim #24 of ECAST SETTLEMENT CORPORATION filed herein by the Trustee, CHRISTOPHER J. REDMOND, the above matter comes on for consideration. The Court finds that on August 5, 2005, the Trustee filed an Objection to Claim #24 of ECAST SETTLEMENT CORPORATION as a general unsecured Claim, as this Claim was not timely filed. The Trustee mailed a copy of his Objection to this creditor, which provided a request for a hearing date, if a request was made on or before August 25, 2005. No response has been received from this creditor, no hearing was held on the Objection and the Trustee moves that the Objection to Claim #24 be Sustained.

Thereupon, after reviewing the Objection filed by the Trustee regarding Claim #24 of ECAST SETTLEMENT CORPORATION and the statements contained herein, the Court finds that said Objection should be and is hereby Sustained.

IT IS, THERFORE, ORDERED, ADJUDGED AND DECREED that the Trustee's Objection to Claim #24 of ECAST SETTLEMENT CORPORATION is hereby Sustained and Claimant shall not be entitled to participate in the distribution of any dividends.

SO ORDERED.
