AND NOW, upon consideration of the U.S. Trustee's Motion for Reconsideration and/or Amendment of the Bankruptcy Court's Memorandum Opinion and Order dated January 25, 2007 ("the Motion"), and the response thereto of Respondent Gennaro Rauso,
AND, the Court having scheduled a hearing on March 9, 2007,
AND, prior to the completion of the hearing, the parties having reported to the Court that they reached a settlement,
AND, the parties having placed on the record on March 9, 2007, the terms of their settlement,
AND, the parties intending that the terms of the settlement be binding upon them immediately upon Court approval of the settlement,
AND, the parties having requested on the record on March 9, 2007 that the settlement be approved immediately by the Court so that the settlement terms could be effective immediately,
WHEREFORE, as already stated orally in open court on March 9, 2007, it is hereby ORDERED that: 1. The settlement between the U.S. Trustee and Respondent, Gennaro Rauso, as set forth in open court on March 9, 2007, is APPROVED. It is FURTHER ORDERED, consistent with the terms of the approved settlement that: 2. The Court's Memorandum Opinion dated January 25, 2007 and Order dated January 25, 2007, both of which were entered on the docket on January 26, 2007, are hereby VACATED. 3. The Court will retain jurisdiction over the implementation and/or enforcement of the terms of the approved settlement.
