GARY BROWN v. KAREN BROWN.

MEMORANDUM OF DECISION

OWENS, J.T.R.

The defendant's motion to open evidence is granted. However, the reopening of the evidence is limited to defendant's claim as it relates to the sale of a condominium located at 211 West 16th Street. It has been represented that at the time of trial the defendant was not aware that said unit was in the process of being sold. It is also represented that counsel for the plaintiff was unaware of the contemplated sale. At the time of hearing on 7/29/09 counsel for the plaintiff was unable to ascertain whether the condominium was under contract for sale or whether there was a closing. It is hereby ordered that if said unit has been sold and a closing held or if sale is contemplated that one-half (50%) of the proceeds of sale be placed in an interest bearing escrow savings account with Attorney Norman Roberts as the sole escrow agent. Plaintiff shall provide defendant with a copy of the contract for sale as well as a closing statement within thirty days of the date of a closing and proof that an escrow account has been established.
