THOMAS TUCKER, Bankruptcy Judge
On March 29, 2011, Debtor filed a plan and disclosure statement, in a document entitled "H HM Incorporated's First Amended Combined Plan of Reorganization and Disclosure Statement" (Docket # 35). The Court cannot yet grant preliminary approval of the disclosure statement contained within this document ("Disclosure Statement"). The Court notes the following problems, which Debtor must correct.
First, Debtor still has not included in its Plan and Disclosure Statement all of the required information in the order and format listed in the "Requirements for Information to Include in the Combined Plan and Disclosure Statement (Judge Tucker)" (the "Requirements") available on the Court's website at:
http://www.mieb.uscourts.gov/rulesAndForms/forms/Combined%20Plan%20and%20Disclosure%20Statement%20-%20Judge%20Tucker.pdf. For example, Debtor did not provide information on (1) the background of Debtor's principal, Hussein Mouzahem, such as his education and work history ( see Requirements ¶ II.B.1); (2) whether Debtor paid Hussein Mouzahem any fringe benefits ( see Requirements. ¶ II.B.2) (if Debtor did not pay any fringe benefits to Hussein Mouzahem, the Disclosure Statement must state this); (3) whether there have been any post-petition transfers outside the ordinary course of business ( see Requirements ¶ III.A) (if there have been no such transfers, the Disclosure Statement must state this); (4) the details of cash collateral, post-petition financing and adequate protection orders ( see Requirements ¶ III.B) (if there have been no such orders, the Disclosure Statement must state this); (5) any litigation during the case ( see Requirements ¶ III.C); (6) whether any debt is guaranteed by anyone or if anyone is liable with the debtor on any debt ( see Requirements ¶ IV.F). Debtor must correct these deficiencies.
Second, Debtor must state what administrative claims are being treated under Paragraph 2.1 of the Plan on page 7 and estimate the amount of each of the claims ( e.g., United States Trustee quarterly fees in the amount of $650.00, and other professional fees, such as Debtor's attorney).
Debtor indicates on page 21 of the Disclosure Statement that the estimated fees for Debtor's attorney are $0.00. But Debtor's "Statement of Attorney For Debtors(s) Pursuant to F.R.Bankr.P. 2016(b)" (Docket # 1) states that Debtor's attorney fees will be billed "at an hourly rate of $225.00" and that a retainer of $1,369.00 was paid by Debtor. If this has changed — e.g., if Debtor's counsel has agreed to waive all attorney fees — Debtor must say so. Otherwise, Debtor's attorney fees must be listed, estimated, and treated as an administrative claim under Paragraph 2.1 of the Plan.
Third, Debtor must state what priority claim(s) under 11 U.S.C. § 507(a)(8) are being treated under Paragraph 2.3 of the Plan on page 7, and estimate the amount of each such claim ( e.g., the priority tax claim of the Internal Revenue Service in the amount of $353.12).
Fourth, Debtor must provide meaningful summaries of the financial information in a consistent format, in a line itemization format listing all income and expense categories, for three years pre-petition. Debtor must also provide projections for the period of payment proposed by the Plan in the same line itemization format.
Fifth, Debtor must state whether Hussein Mouzahem will be paid fringe benefits post-confirmation, and must describe any such benefits.
Sixth, Debtor must delete paragraphs 2(b) and 2(c) of Paragraph V.E.2 of the Disclosure Statement on page 27, and must delete the last sentence, which states: " See Part II-A of this Disclosure Statement to determine which of the above paragraphs applies in this case."
Accordingly,
IT IS ORDERED that no later than April 7, 2011, Debtor must file an amended combined plan and disclosure statement which corrects the above stated problems.
IT IS FURTHER ORDERED that Debtor also must provide to Judge's chambers, no later than April 7, 2011, a redlined version of the amended combined plan and disclosure statement, showing the changes Debtor has made to "H HM Incorporated's First Amended Combined Plan of Reorganization and Disclosure Statement" (Docket # 35), filed March 29, 2011. Debtor must submit this redlined document to chambers electronically, through the Court's order submission program.
