J U D G M E N T (oral)
1. Petitioners seek quashing of FIR No. 0583/2024, registered at Police Station Shalimar Bagh, for commission of offences under Sections 76/79/115(2)/3(5) of Bharatiya Nyaya Sanhita, 2023 (corresponding Sections 354B/509/323/34 IPC), along with all consequential proceedings arising therefrom, on the basis of compromise arrived at between the parties.
2. Aforesaid FIR registered on the basis of complaint made by respondent No. 2 herein (name withheld), who alleged that her daughter-in-law along with her sister had created commotion and made allegations against her son that he was having extramarital affair. They both abused and assaulted her and even torn her wearing clothes.
1
3. The aforesaid allegations resulted in registration of aforesaid FIR. Matter is still at the stage of investigation.
4. Quashing is being sought for the reason that all the disputes have been amicably resolved.
5. Learned counsel for the parties submit that there was a cross FIR i.e. FIR No. 382/2024. Such cross FIR was registered by the same police station i.e. PS Shalimar Bagh and it has also been quashed by this Court vide order dated 19.08.2026 passed in Crl. M.C. No. 6085/2026.
6. Copy of such order has been shown during the course of arguments.
7. It is directed to be retained on record.
8. Respondent No. 2 is present and submits that matter has been amicably settled and, therefore, she has no objection if the FIR is quashed.
9. Copy of Memorandum of Understanding dated 03.06.2026 is on record and as per such settlements, parties have buried all their disputes and differences and have agreed to go for quashing of respective FIRs.
10. It is submitted that parties are staying together and there is no matrimonial discord between them at the moment.
11. Respondent No. 2 submits that she has entered into the abovesaid settlement out of her own free will, without any coercion and influence from any corner whatsoever and therefore, she would have 'no objection' if FIR in question is quashed.
12. In view of the settlement arrived at between the parties, continuing with criminal proceedings would serve no useful purpose when a cross-FIR has already been quashed. In any case, even the complainant does not wish to press any charges against the petitioner.
13. Accordingly, exercising inherent powers vested in this Court under
2
Section 528 of the BNSS, it is deemed appropriate to quash the instant FIR.
14. Consequently, to secure the ends of justice, FIR No. 0583/2024, registered at Police Station Shalimar Bagh, for commission of offences under Sections 76/79/115(2)/3(5) of Bharatiya Nyaya Sanhita, 2023 (corresponding Sections 354B/509/323/34 IPC), along with all consequential proceedings arising therefrom, is quashed.
15. Original affidavits of the parties, copies of which have been filed with the present petition, shall be submitted before the concerned SHO/IO within four weeks from today so that these become part of Record.
16. The petition stands disposed of in aforesaid terms.
