    Heard Ms. Anupama Bhadauria, learned counsel for the petitioner.

    The present appeal was preferred against the judgment and order dated 19.03.2026 passed by the learned Principal Judge, Family Court, Lucknow, whereby an application seeking waiver of the six-month cooling-off period was rejected.

    Learned counsel for the appellant submits that the period of six months has already elapsed. In view of this, the case of the appellant can now be considered on merits by the learned Principal Judge, Family Court, Lucknow. She further submits that the appeal has been rendered infructuous and therefore, prays that the same be dismissed as such.

    Accordingly, the appeal is dismissed as infructuous with liberty to the appellant to press the application for the second motion. Upon such presentation, the Court below shall proceed to consider the same keeping in view the fact that the cooling-off period has already expired.
