Krishna Nand Kesarwani v. State Of U.P. And 2 Others

HIGH COURT OF JUDICATURE AT ALLAHABAD

    WRIT - C No. - 41109 of 2025 Court No. - 1

    HON'BLE AJIT KUMAR, J.

    HON'BLE SWARUPAMA CHATURVEDI, J.

Heard Sri Lalit Kumar Misra, learned counsel for the petitioner as well as learned Standing Counsel.

Instructions placed today are taken on record and a copy of which is supplied to learned counsel for the petitioner.

By means of this petition filed under Article 226 of the Constitution, petitioner has questioned the impugned notice dated 30.09.2024 as well as its confirmation notification dated 06.05.2025.

Learned Standing Counsel was directed to obtain instructions in the matter which is taken on record. In the instructions it has come to be stated that only Temple namely Shivala and the old Well falling in plot no. 561 declared as protected monument to conserve being of ancient time, however, in so far as the residence of the petitioner is concerned, that is not taken into the notification.

Sri Misra however submits that in the name of conservation of old Temple and Well the respondents will construct boundary wall and thereby restrict ingress and egress of the petitioner in his abadi.

Upon a pointed query being made, learned Standing Counsel submits that the protected monuments are only Temple and Well and there is no question of creating any such boundary wall which may stop passage of the petitioner through his residence in the Abadi area.
