SUNDAR SINGH v. RAJENDRA SINGH and OTHERS

WPMS No. 717/2013 Hon’ble V.K. Bist, J. Heard Mr. Nagesh Agarwal, Advocate for the petitioner and perused the record. By way of instant petition, the petitioner is seeking direction to the Court of Civil Judge, (Sr. Div.), Roorkee to decide the Misc. Case No. 26 of 2007 ‘Sunder Singh vs. Rajendra Singh & others’, pending before him expeditiously as early as possible. Learned counsel for the petitioner submits that petitioner had filed a contempt petition against the respondents for willful disobedience of the Court order under Order 39 Rule 2 (a) read with Section 151 C.P.C. He submits that respondents are delaying the proceedings in one way or another seeking unnecessary adjournments. He further submitted that the proceeding is summary in nature. He prayed that direction may be issued to the Court concerned to decide the said case expeditiously. Considering the submissions of learned counsel for the petitioners and having had perused the order-sheet of the case, the writ petition is disposed of by directing the Court of Civil Judge, (Sr. Div.), Roorkee to decide the Misc. Case No. 26 of 2007 ‘Sunder Singh vs. Rajendra Singh & others’, pending before him expeditiously, preferably before 31st December, 2013. (V.K. Bist, J.) 05.04.2013 NCM:
