Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the first respondent to exercise the powers conferred under Article 338(5)(a)(b) of the Constitution of India to take appropriate actions against the respondents 4 and 5 to get compensation of Rs.42,00,000/- and other benefits on the petitioner's petitions dated 01.08.2015 and 03.08.2015.

    Mr.M.Rajarajan for R.4

    ORDER

    None appears for the petitioner.

    2. The case is posted under the caption "for dismissal". I went through the averments set out in the affidavit filed in support of the writ petition. It is seen that the petitioner was employed in TVS and Sons Private Limited from 2006-2012. He was terminated from service. The petitioner is under the impression that he is victim of caste animosity. He also claims that he should be paid compensation and also salary arrears. These are not matters that can be resolved in writ jurisdiction. The dispute is essentially one between the

terminated employee and the Management of the company. The said company cannot be termed as a state instrumentality within the meaning of Article 12 of the Constitution of India. The very filing of this writ petition is misconceived.

    3. This writ petition is dismissed. There shall be no order as to costs.
