CORAM: HONOURABLE JUSTICE SMT. ANJANA PRAKASH

    ORAL JUDGMENT

    Date: 24-11-2015

The parties had resolved to end the criminal proceedings on

certain terms by which the complainant was to be given part of the

ancestral property which fell in her husband’s share which was given

but the O.P. No. 2 is not satisfied and hence she seeks permission to

raise her objections before the Civil Court. She is permitted to do so.

Considering that the dispute seems to arise only around

property and no offence under Section 498A is made out, the

application is allowed and the order of none discharge dated

22.12.2011 passed by the Sub-Divisional Judicial Magistrate,

Biharsharif, Nalanda in Case No. 614C of 2009 is hereby set aside.
