G.S. Patel, J.:— I have heard both Ms. Khandke for the Plaintiff (“Pushpa”) and Mrs. Koparkar for the Defendant and Applicant (“Titus”) in the Notice of Motion yesterday and again this morning. Both parties are present in Court. Pushpa is Titus's sister-in-law. Titus was married to Pushpa's sister, Ruth, the deceased. Both are contesting for representation to her estate. Each has adopted different proceedings.
2. It seems that Pushpa had earlier given a flat at 15-C, Jivan Jyot Apartment, C-Wing, 5 Floor, Kansai (Bhidewadi), Ambernath (East), District Thane on Leave and License to one Mr. Karmendra Kumar Mishra. That Leave and License Agreement expired in May 2016. Despite a specific order directing her not to renew that Leave and License Agreement, she has done so by an 11-month Leave and License Agreement dated 14 June 2016 with the same Licensee and which is effective till 13 May 2017.
3. Titus has obtained a copy of the Leave and License Agreement. This is in itself unusual, because he is not a party to the document. Ms. Khandke says that Titus regularly visits the flat in question and threatens the occupant or Licensee. This is denied by Mrs. Koparkar, though she does agree that Titus obtained the document from the Licensee. Both parties claim to be entitled to the flat and to the license income from it.
4. In addition, Mrs. Koparkar says that the Pushpa is liable to bring back to Court the amount of Rs. 9,51,970/- that she withdrew from the J.J. Group of Hospitals where Ruth was working as a Nurse. It is not in dispute that this amount was in fact taken by Pushpa. Ms. Khandke says that the amount has been used to pay off the deceased's estate's debts. Those details are presently unavailable.
5. I will require Ms. Khandke to make a provision for securing Rs. 9,51,970/-. I will also need to make an order in regard to the deposit of the license fees for this flat in future. At present, without further hearing, I cannot make that order. In any case, Ms. Khandke needs to file an Affidavit annexing the two Leave and License Agreements (i.e., one before May 2016 and the current Leave and License Agreement) and also to explain how the amount of Rs. 9,51,970/- has been used or applied by Pushpa and towards the satisfaction of which debts.
6. In view of the nature of the proceedings and the provisions of Section 269 of the Succession Act, 1925, and the settled law on the subject it is not possible to appoint a Receiver of the flat in question. Both side state that they will not create any third party rights, alienates or induct any person hereafter with the flat. Pushpa has already made such a statement. Now Titus makes a similar statement. Both are accepted. There is to be as new Leave and License nor any renewal of the existing one without leave of this Court after at least one week's notice.
7. Ms. Khandke states that she will file and serve Pushpa's Affidavit on or before 13 October 2016. Mrs. Koparkar will also file Titus's Affidavit setting out what precisely he has done in regard to the flat in question, i.e., whether he has executed any document in that regard, whether in his favour or some other person's favour.
8. List the matter on 18 October 2016.
9. In the meantime, the Affidavit filed by Pushpa apologizing for the renewal of the Leave and License Agreement is taken on record.
10. A copy of the Leave and License Agreement tendered by Mrs. Koparkar is taken on record and marked “X” for identification.
