K.P. Jyothindranath, J.:— This is an original petition filed under Article 227 of the Constitution of India. The grievance of the petitioners are that the claimant in LAR No. 319/1999 on the files of the Sub Court, Muvattupuzha, is no more. The petitioners herein moved I.A. No. 125 of 2018 before the court stating that before the death of the claimant, he had executed an “unregistered will” and even though the said will was produced before the court, notice ordered to the other legal representatives of the original claimant without acting on the will produced as stated above. The challenge is against the said order.
2. The short order of the court below is as follows: “Unregistered will deed produced. Issue notice to other legal representatives of original claimant in the L.A.R. Counter and hearing to 23.06.2018”.
3. Thus, what comes out is that an unregistered will is produced, but notice ordered to the other legal heirs of the deceased. The learned Counsel is relying upon a decision of this Court in Dr. John K. Philip v. Treasury Officer, Kumbanad reported in 2017 (4) KHC 561. It is a matter relating to a deposit of money in a Treasury bank account. Here, the subject matter is immovable landed properties under acquisition. Under such circumstances, it cannot be said that the impugned order is perverse. No interference is necessary.
4. Thus, the Original Petition (Civil) is dismissed in limine.
