WP NO.63914-915/2016 (APMC) VIDE ANNEX-E DOES NOT PERTAIN TO COOPERATIVE MARKETING SOCIETIES AND AGRICULTURAL COOPERATIVE PROCESSING SOCIETIES CONSTITUENCIES OF DAVANAGERE AGRICULTURAL PRODUCE MARKETING COMMITTEE AS PER SECTION 11(iv) & (v) OF THE ACT AND DIRECT THE RESPONDENTS TO ISSUE FRESH ELECTION NOTIFICATION IN RESPECT TO THOSE TWO CONSTITUENCIES AND COMPLETE THE SAME IN ACCORDANCE WITH LAW., ETC. THIS PETITION COMING ON FOR PRELIMINARY HEARING THIS DAY, THE COURT MADE THE FOLLOWING: ORDER The petitioner has filed this writ petition praying to issue clarification that the order dated 16.12.2016 in W.P. Nos.63914-915/2016 (APMC) does not pertain to co-operative Marking Societies and Agricultural Co-operative Processing Societies constituencies of Davangere Agricultural Produce Marketing Committee as per Section 11(iv) and (v) of the Act and direct the respondents to issue fresh election notification in respect to those two constituencies and complete the same in accordance with law and etc.
2. In respect of the prayer made by the petitioner, this writ petition does not survive for consideration. If petitioner requires any clarification, he may prefer an appeal and further, as per the said order, election is already held.
3. In this circumstance, the writ petition does not survive for consideration and hence, it is dismissed as having become infructuous. Sd/- JUDGE
