Kailash Chandra Hritwal v. The State Of Rajasthan & Others.

Mohammad Rafiq, J.:— This writ petition has been filed by the petitioner contending that the respondents issued an advertisement on 10.07.2013 inviting applications for recruitment on the post of Lab Assistant. The petitioner has also completed Diploma in Medical Laboratory Technician from Bharat Sevak Samaj, New Delhi. He has also completed Bachelor of Science in Medical Laboratory Technology (Lateral) from Vinayaka Missions University. The petitioner being eligible applied for the aforesaid post. The respondents called the candidates for document verification and counseling. Thereafter, the respondents issued provisional list of candidates in which the petitioner was not included. It is argued that the respondents have selected some candidates who are less meritorious than the petitioner. The petitioner has completed diploma from the recognised institute. He has also completed his Diploma in Medical Laboratory Technician Course from Bharat Sevak Samaj, New Delhi, which is approved by UGC, AICTE and DEC. The qualification for the post of Lab Assistant is diploma in Lab Assistant done from institute which is recognised by Central Government. Thus, it is clear that the petitioner has done his diploma from institute which is recognised by Central Government, but the respondents have not given appointment on the aforesaid post. Action of the respondents is arbitrary, illegal, unjust and not tenable in the eyes of law.

    2. Certificate produced by the petitioner from Bharat Sevak Samaj, New Delhi has not been considered to be recognised by the State Government. The petitioner has failed to produce any such proof of recognition of certificate as per condition no. 6.3 of the advertisement, i.e educational qualification of secondary and with regard to professional qualification it is provided that the candidates should have diploma or certificate of Medical Laboratory Technician from an institute recognised by the State Government or experience of one year in a medical laboratory run by the State Government. There is no merit in this writ petition, which is accordingly dismissed.

    3. Stay application also stands dismissed.
