    Babaraje v. State Of Karnataka

H.G Ramesh, J. (Oral):— This intra-court appeal is directed against the order dated 24.07.2015 passed by a learned Single Judge of this Court in Writ Petition No. 104860/2015.

    2. We have heard learned counsel appearing for the appellants and perused the impugned order.

    3. Learned counsel for the appellants submitted that the appellants' father's land measuring 2 acres 24 guntas was acquired in the year 1973 by the Karnataka Industrial Areas Development Board pursuant to the final acquisition notification dated 21.11.1972 The grievance of the appellants is that the said land has not been utilized, and therefore, they are entitled for return of the land.

    4. On being asked, learned counsel for the appellants was not able to refer to any provision of law under which the appellants are entitled for return of the land which was admittedly acquired as per law several decades ago.

    5. In our opinion, dismissal of the writ petition by the learned Single Judge is in accordance with law. The appellants have no legal right for return of the land which was validly acquired as per law several decades ago. The impugned order of the learned Single Judge does not suffer from any legal infirmity to warrant interference. Hence, no purpose will be served by ordering notice on the application filed for condonation of the delay in filing this writ appeal. Accordingly, I.A Nos. 1, 2 and 3/2015 and the writ appeal are dismissed.

    6. Appeal dismissed.
