Rajan Gupta, J.
By this common order, two Criminal Miscellaneous bearing Crl. Misc. No. M-944 of 2009 and Crl. Misc. No. 3922 of 2009 shall be disposed of.
The petitioners have filed these petitions under Section 482 Cr.P.C for quashing of FIR No. 182 dated 29th July, 2007, under Sections 323, 324, 325, 427 read with Section 34 IPC, registered at Police Station Sadar, Jalandhar, and cross case under Sections 323, 452 IPC, registered on the statement of Ravi Dutt in the aforesaid FIR at the same Police Station and the subsequent proceedings arising therefrom, on the basis of compromise, arrived at between the parties.
Notice of motion in CRM No. M-3922 of 2009.
On asking of the Court, Mr. Shailesh Gupta, DAG, Punjab accepts notice.
The complainant in the present FIR as well as the complainant in the cross case are present in Court. The complainant in the FIR case namely, Amardeep Singh has been identified by Mr. Sudhir Pruthi, Advocate. Ravi Dutt, who is stated to be the complainant in cross case, has put in appearance through his father Parkash Dutt as an Attorney of his son. The said complainant has been identified by Mr. R.S Bajaj, Advocate. The complainants in both the cases have filed their respective affidavits, which are taken on record as Mark ‘A’ & Mark ‘B’ respectively, to the effect that they have no objection if the present FIR as well as cross case are quashed.
The compromise is in the interest of the parties and after the matter has been resolved by an amicable settlement, no useful purpose is likely to be served with continuance of the criminal proceedings, which would be a futile exercise.
In view of the above, the present FIR as well as the cross-case and the consequent proceedings deserve to be quashed in the light of the decision of Full Bench of this Court in Kulwinder Singh and others v. State of Punjab, 2007 (3) RCR (Crl.) 1052.
Resultantly, the present petition is allowed, the FIR as well as the cross case and the subsequent proceedings arising therefrom are quashed.
