    Ashish Seth v. State Of U.P.

    Court No. - 48

    Case :- CRIMINAL MISC. BAIL APPLICATION No. - 15012 of 2014

    Applicant :- Ashish Seth

    Opposite Party :- State Of U.P.

    Counsel for Applicant :- Arun Srivastava

    Counsel for Opposite Party :- Govt.Advocate

    Hon'ble Virendra Vikram Singh,J.

    Heard learned counsel for the applicant, learned Additional Government Advocate and

    perused the record.

    It has been argued that the robbery was committed by three miscreants, who were

    covering their faces. The only evidence against the applicant is the confession of the co-

    accused coupled with the recovery of ornaments on 27.1.2014.

    On behalf of the applicant false implication has been pleaded. There does not exist any

    previous criminal antecedent against the applicant.

    Learned AGA opposed the prayer for bail.

    Having considered the facts and circumstances of the case, I am of the opinion that a fit

    case for bail is made out.

    Let the applicant Ashish Seth be enlarged on bail on his furnishing a personal bond and

    two sureties each in the like amount to the satisfaction of the court concerned in Case

    Crime No.15 of 2014, under Sections 392, 411, 120B, IPC, Police Station Kerakat,

    District Jaunpur with the following conditions:-

    (1) That the applicant shall cooperate in the expeditious disposal of the trial and shall

    regularly attend the Court unless inevitable;

    (2) That the applicant shall not directly or indirectly make any inducement, threat or

    promise to any person acquainted with the facts of the case so as to dissuade him from

    disclosing such facts to the Court or to any police officer or tamper with the evidence;

    (3) That after his release, the applicant shall not involve in any criminal activity.

    Order Date :- 14.5.2014
