    CHIEF OFFICER, DEHGAM NAGARPALIKA v. NAVINCHANDRA G. PATEL

    C/SCA/12074/2022 ORDER DATED: 06/07/2022

    IN THE HIGH COURT OF GUJARAT AT AHMEDABAD

    R/SPECIAL CIVIL APPLICATION NO. 12074 of 2022

    ========================================================== CHIEF OFFICER, DEHGAM NAGARPALIKA

    Versus NAVINCHANDRA G. PATEL

    ========================================================== Appearance: MR KARMANYASINGH V RORE(10920) for the Petitioner(s) No. 1,2 for the Respondent(s) No. 1 ==========================================================

    CORAM:HONOURABLE MR. JUSTICE UMESH A. TRIVEDI

    Date : 06/07/2022

    ORAL ORDER

    This petition prays for stay of warrant of possession issued

    pursuant to a judgment and decree passed by the trial Court.

    However, Mr.Karmanyasingh V. Rore, learned advocate for the

    petitioners submitted that they have already preferred the

    appeal against the judgment and decree and therefore, if at all,

    any relief is to be prayed for seeking stay of warrant of

    possession would be available to the petitioners before the

    appellate Court.

    In view thereof, this petition, which is filed straightway

    here, praying for setting aside the order of warrant of possession

    cannot be entertained. Hence, it is rejected.
