07/10.02.2016 Learned Senior counsel relies upon a judgment rendered by
the Apex Court in the case of S. J. Coke Industries Pvt. Ltd. and
Ors. Vs. Central Coalfields Ltd. and Ors. reported in (2015) 8
SCC 72 in order to support the submission that issue raised herein
relating to refund of excess money collected by the Coal Company
with interest is no longer res-integra.
Learned counsel for the respondent-BCCL prays for short
time to go through the said judgment and advance the submission.
Counter affidavit has already been filed earlier.
Accordingly, as prayed for on behalf of the respondents, list
these cases on 24.02.2016 under the heading for Admission.
