JUDGMENT
The petitioners, who are pursuing the 6thSemester - B.Sc. Mathematics in the Thunchath Ezhuthachan Memorial Government College, Malappuram, affiliated to the 1strespondent - University, seek that the results of their examinations be directed to be published without any further delay.
2. However, Sri.P.C.Sasidharan - learned Standing Counsel for the Calicut University, submitted that the afore request of the petitioners - as made by their learned counsel - Smt.Thulasi K. Raj, is not as innocuous as it sounds, because the University has reliable information that they had committed misconduct in the examinations. He submitted that an enquiry into the same is now going on and hence prayed that this writ petition be dismissed.
3. Even when I hear Sri.P.C.Sasidharan on the afore lines, and examine Ext.P6, it is evident that, as of now, the University only says that there is a "suspicion" regarding examination malpractice by the petitioners. Of course, this Court does not intend to enter into the merits of the said allegation at this stage, but I am certain that the competent Authority of the University must complete enquiry into the same, after hearing the petitioners also, without any avoidable delay, so that, if the imputations are found to be incorrect, their results can

be published. Resultantly, I order this writ petition with the following directions:
(a) The University is left full liberty to complete proceedings on the suspicion of malpractice by the petitioners, after following due procedure and after affording them an opportunity of being heard; thus culminating in appropriate order and action thereon as expeditiously as is possible, but not later than one month from the date of receipt of a copy of this judgment.
(b) If, through the afore exercise, the allegations against the petitioners are found to be untrue, then their results will be published within a period of one month thereafter.
(c) On the contrary, if the enquiry as ordered in (a) above is to find against the petitioners, then they will be at full liberty to challenge the same; for which purpose, all their contentions are left open.
