Thurupati Venkatesh Rep. By His Father Thurupati Krishnaiah v. State Of Andhra Pradesh, Rep. By Its Principal Secretary And Others

Arup Kumar Goswami, C.J.:— Heard Mr. G. Venkata Reddy, learned counsel for the petitioner.

    2. Also heard Mr. T.N.M. Ranga Rao, learned Govt. Pleader for Social Welfare, for respondent Nos. 1, 2 & 4, Mr. G.L. Nageswara Rao, learned Govt. Pleader for Revenue for respondent No. 3 and Mr. N. Harinath, learned Asst. Solicitor General, for respondent Nos. 6 & 7.

    3. This writ petition is filed seeking a writ of mandamus declaring the action of respondent Nos. 2 to 8 in not considering the candidature of the petitioner for admission into MBBS Medical Course or any other course through the counselling being conducted by respondent Nos. 2 to 8 under Budaja Jangam (S.C. category) as per his merit for the academic year 2019-20, as illegal, arbitrary and to consequently direct respondent Nos. 2 to 8 to consider the candidature of the petitioner.

    4. The case set out in the writ petition is that the petitioner belongs to Budaga Jangam caste, which is recognized as Scheduled Caste under the Constitution (Scheduled Caste) Order, 1950.

    5. It appears that an interim order was passed on 19.07.2019, providing further that the interim arrangement shall be subject to the outcome of the writ petition. It was also made clear that the petitioner would not claim any equities at the time of adjudication of the issue in the main writ petition.

    6. Learned counsel for the parties submit that in W.A. Nos. 389 and 390 of 2020 disposed of on 17.02.2021, it was held that Budaga Jangam caste is not yet included in the S.C. category in the State of Andhra Pradesh and, therefore, petitioners in the said writ petitions cannot claim the benefit of their caste in the State of Andhra Pradesh.

    7. In that view of the matter, learned counsel for the parties submit that the petitioner herein is not entitled to claim admission on the basis of the caste certificate.

    8. We have perused the order dated 17.02.2021 passed in W.A. Nos. 389 and 390 of 2020.

    9. In view of the submission of the learned counsel for the parties, this writ petition is liable to be dismissed and the same is, accordingly, dismissed. No order as to costs. Pending miscellaneous applications, if any, shall stand closed.
