Kumari Mohanam K.P. v. Corporation Of Thiruvananthapuram Palayam

    S. Manikumar, C.J.:— This writ appeal is directed against the judgment in W.P.(C) No. 19594 of 2019 dated 18 July 2019, by which learned Single Judge declined to interfere with Ext. P14 order, dated 3 May, 2019, passed by the Tribunal for Local Self Government Institutions, Thiruvananthapuram, in Appeal No. 153 of 2018.

    2. Heard Sri. P.G. Jayashankar, the learned counsel appearing for the appellant as also Sri. Nandakumara Menon (Sr.), learned Standing Counsel appearing for the Corporation of Thiruvananthapuram.

    3. Having heard learned counsel for the parties and having perused the materials available on record, we are of the view that the direction issued by the learned Single Judge does not call for any interference in the facts and circumstances of the case.

    4. However, learned counsel for the appellant submitted that a direction may be issued to the first respondent/the Secretary, Corporation of Thiruvananthapuram to act as per Ext. P14 order of the Tribunal, without any further delay. Responding to this, learned Standing Counsel for the Corporation submitted that action as ordered by the Tribunal in Ext. P14 order would be taken at the earliest.

    5. In view of the above, writ appeal is disposed of with a direction to the first respondent to act as per Ext. P14 order of the Tribunal, as early as possible, at any rate, within two months from the date of receipt of a copy of the judgment.

    6. Writ appeal is disposed of.
