S.C. Gupte, J.:— This Application seeks direction for allowing thirty daily rated temporary employees, on whose behalf inter alia the present writ petition is filed, to resume their duties in the employment of the Respondent Corporation so as to allow them to continue work without any break in employment. The Petition has been admitted. By an interim order passed on 29 June, 2010, statement of learned Counsel for the Respondent Corporation inter-alia requiring the Corporation not to recruit anyone for the work carried on by the concerned workmen, was recorded. In view of that statement, no orders protecting the service of the workmen were passed on 29 June, 2010. It was, however, made clear that if any workmen were to be employed by the Respondent-Corporation on the same basis as the workmen whose names figure in Annexure A-1 to the Petition, the latter would get precedence over new incumbents.
2. It is the grievance of the Applicant/Petitioner that despite vacancies advertised for the same work, workmen figuring in Annexure A-1 of the Petition were not being given precedence.
3. Anyway, considering that the Petition itself is now ripe for hearing, the Civil Application may be taken up along with the main Writ Petition. Hearing of the Petition is accordingly expedited. The Petition to appear on 07 January, 2020 for final hearing on the main board along with the Civil Application.
